Most of them crossed the border into China, to which the Government of the People's Republic of China (the PRC) responded by forcibly repatriating defectors to North Korea, thus placing many of them at risk of being subjected to inhumane and degrading treatment and, at times, even death. This article provides an overview of the situation of North Korean asylum seekers and analyses the legal protection available to North Korean defectors under international law. The article focuses specifically on the situation of North Koreans in mainland China and China's obligations under international human rights and refugee law. The aim of the article is to contribute to the elaboration of durable solutions for the plight of North Korean asylum seekers and to develop a range of recommendations for law reform and policy change.

Amid escalating tensions on the Korean Peninsula, we cannot forget those suffering under the North Korean regime and those North Korean refugees who are in China. North Korean asylum seekers are in imminent risk of repatriation, torture, sexual violence, forced abortions, hard labor, and even execution. China's repatriations of the North Koreans is a stark violation of both the spirit and the letter of the Refugee Convention and the 1967 protocol to which China has acceded. The Chinese Government has a lot to answer for. The U.N. Commission on Inquiry for North Korea Human Rights concluded that the Government of the People's Republic of China is aiding and abetting in crimes against humanity by forcefully repatriating North Korean refugees. As many as 90 percent of North Korean women refugees in China today fall prey to traffickers who will sell the refugees into sexual slavery or forced marriages. Labor trafficking is also pervasive. The Government of North Korea and the government and businesses in China, Russia, and elsewhere in the world profit from the trafficking of North Korean laborers.

Book excerpt: The increased international attention given to the situation of North Koreans seeking refuge, primarily in China, has led Congress to take a greater interest in the refugee situation and the underlying causes within North Korea and across its borders. [...] The North Korean Human Rights Act (NKHRA) authorizes the President new funds to support human rights efforts, improve the flow of information, and to require the President to appoint a Special Envoy on human rights in North Korea. [...] The situation raises the questions of what more, if anything, can and should be done-by the United States and the international community-not only to focus attention on the abuses of the DPRK regime, but to alleviate the suffering of North Koreans. [...] The international instruments that provide protection to refugees include the 1951 United Nations Convention Relating to the Status of Refugees (Refugee Convention) and the 1967 Protocol to that Convention.4 A refugee is legally defined in the Refugee Convention as a person fleeing his or her country because of persecution or "owing to well-founded fear of being persecuted for reasons of race, r [...] A much smaller number is estimated to make their way to third countries.12 Clearly, the refugees' need to avoid detection, coupled with a lack of access by international organizations, make it difficult to assess the full scope of the refugee problem; however, based on anecdotal reports, the number of people crossing the border does not seem to have overwhelmed the resources of the Chinese economy.

However, in the early 21st century, there have been some cases in which China has allowed North Koreans to leave China instead of sending them back to North Korea. This thesis examines how China's North Korean refugee policy has changed over the last two decades and whether international factors have influenced this policy. The results suggest that in the 1990's China gave priority to the repatriation agreement with North Korea. However, in the 2000's from its own experience with a number of foreign embassy intrusions by North Koreans, China has learned that the issue has potential for creating diplomatic problems with other countries. To avoid this conflict, China has tactically allowed North Koreans who have gained global attention to leave China, but otherwise still adheres its traditional deportation policy.
