The court ruled that the act of 1791 relative to the killing of slaves was too uncertain to warrant the court deciding to pass a death sentence upon the prisoner. The defendant was convicted under the third section of the act, which stated that if any person shall be hereafter guilty of wilfully and maliciously killing a slave, such offender shall, upon the first conviction thereof be adjudged guilty of murder, and shall suffer the same punishment as if he had killed a free man, any law, usage or custom to the contrary notwithstanding. Lengthy legal argument as to the proper definitions of murder and manslaughter.

The question arose as to whether Walker could bring such an action alone, without the participation of his wife. The court determined that he could.

The plaintiff, the executor, petitioned for the slaves to be delivered, since several years had passed since the testator's death and they had not been emancipated. The court held that emancipation, not having been achieved in a reasonable time, was to be held to be impossible, and so that the slaves should pass to the plaintiff.

Troughton's administrator sued to annul the sale on the grounds that it was a sham, Johnston having been bidding merely to raise the price before letting the slave to go a third party. It was determined that this agreement constituted fraud and that Troughton, as a party to it, could not bring an action to render the sale invalid.
