Book excerpt: The case describes the international problem of money laundering and summarizes U.S. bank regulations aimed at reducing money laundering activities. The introduction of H.R. 3886 in 2000 was one in a series of attempts to formalize U.S. banks' monitoring of their customers. The bill was prompted by a government report that named and criticized U.S. banks for laundering billions of dollars linked to drug trafficking, fraud, and organized crime. Interest groups in favor of H.R. 3886 were predominantly law enforcement agencies that viewed current anti-money laundering laws as ineffective. Groups opposed to the bill included the American Civil Liberties Union, which believed that the collection of more information about bank customers' activities was an invasion of privacy, and the American Bankers Association, which claimed that the legislation would impose unnecessary costs on banks. The case can be used to introduce the distributive politics framework for analyzing non-market issues and formulating nonmarket strategies in the context of government institutions. The epilogue reveals that H.R. 3886 died before it ever reached the House floor, but that an expanded version of the legislation ultimately passed---with the support of stakeholders who originally fought it---as part of the USA PATRIOT Act after the terrorist attacks of September 11, 2001. Since 1983, school reform has been at the top of the national agenda; however, there is a disturbing gap between rhetoric and results. After travelling to some of the nation's largest cities and interviewing administrators and teachers, Carnegie Foundation representatives determined the following priorities for improving urban schools: (1) affirm that every student can succeed; (2) build an effective governance arrangement for urban schools that ends excessively centralized, bureaucratic control; (3) introduce at every school a comprehensive system of renewal that emphasizes preschool and early education, breaks schools into smaller units, defines curricular goals, ensures flexible scheduling, and improves facilities; and (4) create a network of support beyond the school that empowers parents, and involves community, business and government participation. A new National Urban Schools Program is proposed which would: (1) incrementally increase funding of Head Start so that all eligible children are served by the year 2000; (2) increase the appropriation for federal child nutrition programs; (3) each year increase the funding for Chapter 1 of the Education Consolidation and Improvement Act by 5 percent; (4) add to the Education Consolidation and Improvement Act a provision enabling poor parents to place their children in afternoon and summer enrichment programs; (5) make summer fellowships available for teachers; (6) make available to school districts low interest loans to improve school facilities; (7) encourage schools to introduce new curriculum or scheduling arrangements; and (8) encourage cooperation between schools and postsecondary institutions. However, despite this sometimes superhuman representation, one should not forget that we are dealing with a human phenomenon and, therefore, should not lose sight of the corresponding human dimensions. This human dimension also concerns related phenomena, such as money laundering and corruption. This representation forces itself upon us when we look back at the threat images that have been put forward by the authorities, as well as the media, in the past decades. What threats have come true since, say, 1970 or 1980? We still observe the same (criminal) 'business as usual,' together with the alleged accumulation of huge amounts of criminally-influence money. However, these threat images are mainly presented from an 'underworld gaze,' directed at the criminal exploits of hoodlums and thugs 'under' the 'civilized' society and often viewed as coming from abroad. Meanwhile, the criminal (underworld) markets have not faltered. Despite this continued 'threat,' the industrialized world grew steadily richer and safer up until 2008. Then the effects of enduring massive criminal manipulations in the financial 'upperworld' brought this growing affluence to an inglorious end. Corruption is another threat to the fabric of society. Do the anti-corruption policies in countries at the rim of the EU achieve results? There are reasons to believe that most of the policy making effects consist of the facades in a 'Potemkin village': a paper world of ratified conventions, enacted laws, and ineffective institutions - most human and most deceptive. In this volume of the Cross-border Crime Colloquium series, 26 European experts present their latest and on-going studies and research findings.
