Book excerpt: This new edition of EU Employment Law provides a complete revision and update of the leading English language text in the field. The coverage in the new edition has been expanded with material on all the latest developments, incorporating the changes made by the Lisbon Treaty; the EU2020 strategy; the Charter of Fundamental Rights; the 'Article 19 Directives'; the Temporary Agency Work Directive; the revisions to the existing including the Directives on Parental Leave and European Works Council; and the new Social Security Regulations 883/2004. It also analyses the ever-expanding body of employment case law, including the momentous decisions in Viking, Laval, Rueffert, and Commission v Luxembourg. The book begins with an examination of the development of EU employment law focusing on the shift from employment law to employment policy. The text then studies rule-making in the field of employment law, considering both the traditional routes to legislation and governance techniques such as the Open Method of Coordination. The final chapters look closely at the substantive area of employment law, examining the free movement of persons, equal treatment, health and safety and working conditions, the restructuring of enterprises, worker participation, and collective action. Throughout, the book addresses the fundamental question as to the purpose of EU employment law: is it primarily economic, or social, or both?

Available in PDF, EPUB and Kindle. Book excerpt: In Europe, thermoprocessing is the third largest energy consumption sector following traffic and room heating. Its structure is very much diversified and complex. Therefore it is split into a large number of subdivisions, each of them having a high importance for the industrial economy. Accordingly we find the application know-how for the design and the execution of respective equipment represented by a multitude of small but very specialized and significant companies and their experts. As a result there was only little chance to find a comprehensive survey of the practical side of this technology so far. This gap is now filled by the new "Handbook of Thermoprocessing Technologies" based on the contributions of many highly experienced, outstanding engineers working in this field. The main intention of this book is the presentation of practical thermal processing for the improvement of material and parts in industrial application. Additionally, a summary of respective thermal and material science fundamentals is given as well as basic fuel-related and electrical engineering knowledge for this technology and finally design aspects, components and safety requirements for the necessary heating installations are covered. In conclusion, a very wide and competent state of the art description is now available for all manufacturers and users of thermoprocessing equipment. But also specialists from neighbouring fields, students and all those who are generally interested in this important but widely unknown technology will find a quick survey here as well as a very profound expertise.

Book excerpt: In December 2017, the Advisory Committee on Safety and Health at Work (ACSH) adopted its Opinion on the modernisation of six OSH directives to ensure healthier and safer work for all (1). In this document, the ACSH confirmed the need to update the six directives, including Directive 92/58/EEC, as identified by the European Commission in its Communication on safer and healthier work for all - modernisation of the EU occupational safety and health legislation and policy (2). The ACSH recommended that the Commission consider, among other things, clarifying the relationship between the directive and the current ISO standard, and that this could be accomplished by non-binding guidelines. On 30 May 2018, the ACSH set up a working party to prepare an opinion on non-binding guidelines to clarify certain issues regarding the practical application of Directive 92/58/EEC (3) and the interrelationship between Directive 92/58/EEC and ISO standards, in order to ensure a greater harmonisation of safety signs across the EU. With regard to this issue, the ACSH opinion states that, despite the existence of the international instruments on safety signs, the directive takes precedence over those instruments and is an important element of the common protective measures in place in the EU. On 5 November 2020, the working party finalised work on the draft guidelines and the draft opinion, which were subsequently adopted by the plenary of the ACSH on 10 December 2020. The guidelines consist of four parts. Section 1 describes certain legal aspects of the directive and explains the concept of minimum requirements. Section 2 describes in detail a selection of safety signs as laid down by the abovementioned directive and compares them with ISO signs. Annex I provides a list of references and/or practices for further reading. Finally, in Annex II, Table 1 presents different variations of relevant safety signs. It should be highlighted that the guidelines explain the minimum requirements as laid down by Directive 92/58/EEC, whereas Member States are allowed to maintain or adopt stricter requirements. In other words, a degree of freedom is left to Member States to decide which solutions are best in specific national situations, provided that the minimum requirements at EU level are met. Therefore, users in Members States are advised to first check national provisions which implement Directive 92/58/EEC in their national legal systems.

Book excerpt: The Directive 2013/35/EU lays down the minimum safety requirements regarding the exposure of workers to risks arising from electromagnetic fields (EMF). This practical guide has been prepared to assist employers, particularly small to medium sized enterprises, to understand what they will need to do to comply with the Directive. However, it may also be useful for workers, workers representations and regulatory authorities in Member States. It consists of two volumes and a specific guide for SMEs. The practical guide volume 1 provides advice on carrying out risk assessment and further advice on the options that may be available where employers need to implement additional protective or preventive measures. Volume 2 presents twelve case studies that show employers how to approach assessments and illustrate some of the preventive and protective measures that might be selected and implemented. The case studies are presented in the context of generic workplaces, but were compiled from real work situations. The guide for SMEs will assist you to carry out an initial assessment of the risks from EMF in your workplace. Based on the outcome of this assessment, it will help you decide whether you need to take any further action as a result of the EMF Directive.
