Available in PDF, EPUB and Kindle. Book excerpt: Often cited authority on the foundations of law. Originally published: Cincinnati: Robert Clarke & Co., 1874. xiii, 401 pp. Originally written in Latin in 1523, this work contains two dialogues between a doctor of divinity and a student of English law. It popularized canonist learning on the nature and object of law, the religious and moral standards of law, the foundations of the common law and issues regarding the jurisdiction of Parliament. A very important work in the development of equity, Doctor and Student appeared in numerous editions. An authority well into the eighteenth century, it influenced several legal writers, including Blackstone. ". . . surely the most remarkable book relating to English law published in the Tudor period, and quite unlike any book to have come from the pen of an English lawyer before." --Dictionary of National Biography XVII:616. CHRISTOPHER SAINT GERMAIN [c.1460-1540] was a legal writer and controversialist who wrote on a variety of topics. His noteworthy works include A Treatise Concernynge the Dilusion Betwene the Spiritualtie and Temporaltie (1532) and Salem and Bizance (1533). Also a notable bibliophile, his library exceeded that of any other lawyer of his time.

Cloth. $95. * "This volume is composed of five papers or addresses. Two of them are careful historical discussions of the origin of the American doctrine that courts can declare acts of the legislature void; a third shows the influence of theories of political philosophy upon the ante-bellum controversy regarding the nature of the Union; and the remaining two consider the significance of American political parties and their real function in popular government. The two papers first mentioned seem to be contributions of great and permanent value to the discussion of their topic. The style of all of these essays is easy and delightful and their argument sane, thoughtful, and persuasive." J.P.H. Harv. L. Rev. 26:280-281 cited in Marke, A Catalogue of the Law Collection at New York University (1953) 377.

Available in PDF, EPUB and Kindle. Book excerpt: Co-Winner, 2024 V.O. Key Award, Southern Political Science Association Long before American women had the right to vote, states dramatically transformed their status as economic citizens. In the early nineteenth century, a married woman had hardly any legal existence apart from her husband. By the twentieth, state-level statutes, constitutional provisions, and court rulings had granted married women a host of protections relating to ownership and control of property. Why did powerful men extend these rights during a period when women had so little political sway? In Her Own Name explores the origins and consequences of laws guaranteeing married women’s property rights, focusing on the people and institutions that shaped them. Sara Chatfield demonstrates that the motives of male elites included personal interests, benefits to the larger economy, and bolstering state power. She shows that married women’s property rights could serve varied political goals across regions and eras, from temperance to debt relief to settlement of the West. State legislatures, constitutional conventions, and courts expanded these rights incrementally, and laws spread across the country without national-level coordination. Chatfield emphasizes that the reform of married women’s economic rights rested on exclusionary foundations, including protecting slavery and encouraging settler colonialism. Although some women benefited from property reforms, many others saw their rights stripped away by the same processes. Drawing on a mix of qualitative and quantitative evidence, In Her Own Name sheds new light on the place of women in the fitful democratization of the United States.

Hicks, Dictionary of American Biography V:347. His own words reveal Kent as a man of wide learning and literary acumen, gathered here in his views on the Federalist cause, secession, the political situation in Europe, his love of literature, his admiration for Alexander Hamilton and Washington Irving, his career before and on the bench, his life as chancellor, and his correspondence regarding the Commentaries. "Next to my wife, my library has been the source of my greatest pleasure and devoted attachment," he wrote in 1828. (DAB V:347). Included here are notes penned in some of his volumes. Of special interest are the notes that he wrote in Wollstonecraft's Rights of Woman and Tucker's Life of Jefferson. Marke, A Catalogue of the Law Collection at New York University (1953) 1103.
