Available in PDF, EPUB and Kindle. Book excerpt: Prominent policy makers, practitioners, and scholars discuss regulatory reform in the aftermath of the financial crisis of 2008. The financial crisis of 2008 raised crucial questions regarding the effectiveness of the way the United States regulates financial markets. What caused the crisis? What regulatory changes are most needed and desirable? What regulatory structure will best implement the desired changes? This volume addresses those questions with contributions from an ideologically diverse group of scholars, policy makers, and practitioners, including Paul Volcker, John Taylor, Richard Posner, and R. Glenn Hubbard. New Directions in Financial Services Regulation grows out of a conference hosted by the Mossavar-Rahmani Center for Business and Government at Harvard's Kennedy School of Government in October 2009, and the book reflects the dynamic give-and-take of the event. Each part of the book includes not only major papers and presentations but also a summary of the subsequent discussion. The book achieves a balance of academic and practitioner perspectives, with leaders of financial firms and regulatory bodies offering insights based on their experiences in the financial crisis of the year before.

Book excerpt: Now that the Financial Services and Markets Act 2000 has had a chance to bed itself down and the Financial Services Authority (FSA) is developing its new regulatory toolkit and modus operandi, financial regulation has moved on in interesting directions. This book takes a critical look at the principles and practices behind this regulation, as well as the theory that is involved. This book goes further than a description of the laws that are currently out there, by analysing the impact and implications of the new financial regulations, making it a ’must-read’ for law, finance and accounting practitioners. Coverage includes: Regulation and compliance; disclosure risk and regulation and stakeholders in financial regulation.

Book excerpt: In Chapter 5, William Shughart also considers the part that politics played in banking legislation during the 1930s, but he looks at the banking legislation passed in the United States. Shughart draws par ticular attention to the provisions in the Banking Act of 1933 that required the separation of commercial and investment banking activ ities. Applying a public choice analysis, Shughart asks who gained from the provisions, and he concludes that the commercial banking industry, the investment banking industry, and the U. S. Treasury Department can all be said to have benefited in the years immedi ately following the passage of the act. Richard Timberlake, in his comment, extends Shughart's analysis to show how the federal gov ernment manipulated the monetary policy of the 1930s for its own benefit. The history of the regulation of the savings and loan industry is the subject of Chapter 6. James Barth and Martin Regalia examine the way in which regulation of the industry has evolved since the first savings and loan was established in the 1830s. They conclude that the stated purpose of regulation appears to have changed, even while the regulations themselves often have not. Barth and Regalia provide some important insights into the contribution of thrift regu lation to the current problems facing the indusb-y as well as some suggestions about the direction reform should-and should not take.

Book excerpt: The new financial services industryóincluding banks, thrifts, securities dealers, and insurance and real estate investment companiesóis big, diverse, complex, and international in scale. The U.S. regulatory agencies that oversee various parts of this system domestically have been trying for some time to come to terms with the effects of more than a decade of rapid change in the world financial sector. Borrowers and lenders, including individuals, corporations and institutions such as pension funds, have been reacting by making adjustments to their behavior as fast, or as prudently, as possible. In this volume, four leading analysts of this rapidly evolving industry offer proposals ranging from the creation of a new kind of consumer service bank to formation of a new kind of national regulatory agency intended to promote competition within what historically has not been a very competitive structure. Chapters include U.S. Financial Institutions in a World Market by Cynthia A. Glassman; Integrating Banking with Other Financial Services by James L. Pierce; After Glass-Steagall: Financial Institution Reregulation by Roberta S. Karmel; and Financial Restructuring and Its Implications for Consumers by John H. LaFalce. Also contains a glossary of relevant terms.

Book excerpt: Given the rapid evolution of the U.S. financial sector and attendant regulatory challenges, this paper explores ways to fine-tune U.S. oversight arrangements. It surveys the financial landscape, separating a highly regulated, multi-business, and (in terms of relative asset holdings) shrinking “core” from a lightly regulated, more specialized, and rapidly expanding “periphery”; explains the U.S. regulatory philosophy and structure, with its focus on core institutions and its jurisdictional complexity; highlights certain new challenges, without presuming to have all the solutions; draws out some broad policy implications, from the “30,000 foot level”; and concludes by tabling and discussing one, specific, reform idea.

Available in PDF, EPUB and Kindle. Book excerpt: This edited collection brings together established global scholars and new thinkers to outline fresh concepts and theoretical perspectives for criminological research and analysis in the 21st century. Criminologists from the UK, USA, Canada and Australia evaluate the current condition of criminological theory and present students and researchers with new and revised ideas from the realms of politics, culture and subjectivity to unpack crime and violence in the precarious age of global neoliberalism. These ideas range from the micro-realm of the ‘personality disorder’ to the macro-realm of global ‘power-crime’. Rejecting or modifying the orthodox notion that crime and harm are largely the products of criminalisation and control systems, these scholars bring causes and conditions back into play in an eclectic yet thematic way that should inspire students and researchers to once again investigate the reasons why some individuals and groups elect to harm others rather than seek sociability. This collection will inspire new criminologists to both look outside their discipline for new ideas to import, and to create new ideas within their discipline to reinvigorate it and further strengthen its ability to explain the crimes and harms that we see around us today. This book will be of particular interest to academics and both undergraduate and postgraduate students in the field of criminology, especially to those looking for theoretical concepts and frameworks for dissertations, theses and research reports.

Available in PDF, EPUB and Kindle. Book excerpt: Banking Regulation and World Trade Law concerns the legal aspects of the interaction between banking regulation and international trade in financial services. The author studies the internal banking market of the European Union, the liberalisation of financial services trade in the World Trade Organization, the accords of the Basel Committee on Banking Supervision and the European Central Bank. The book focuses on the balancing between banking regulation and international trade law. It discusses discrimination and proportionality in national banking regulation, the allocation of prudential regulation and supervision between home and host country, and international financial law-making. The author questions decentralised/nation-based banking regulation and supervision as a foundation for a sustainable liberalisation of international trade in financial services. The book considers various reforms of the international financial architecture, such as the incorporation of the Basel processes and accords into the WTO system, and the setting up of new international institutions by building on the Basel Committees or the IMF structures. The role of central banking in designing the international financial architecture is also explored: the book reviews the ECB's competence over foreign exchange policy and its function as lender of last resort, and treats price stability, banking soundness and representation as critical concepts. The analysis also reveals that the concept of 'prudential', despite its extensive use in banking regulation, has not been defined with adequate precision. In seeking to delineate the interface between international economic law and banking regulation, Dr Panourgias builds on the rich European scholarship on institutional financial issues and the US interdisciplinary approach to world trade law. He also entertains the notion of international financial law as a distinct field. The book will be of particular interest to those concerned with financial law and international banking.
