And because it is a question of fundamentals, they will, we imagine, be of interest to many readers. We should like to contribute to a clarification, histor ically and systematically, of some concepts with which every philosophy of society and the state has to deal. We shall admit historical considerations for the sake of insights into the sys tematic ones, and we trust that our inquiry into the systematic will help us to understand the historical. For we are moving in that circle exemplarily described by Johann Gustav Droysen in his Vorlesungen fiber Enzyklopadie und Methodologie der Ge schichte (§ 37) when he writes: 'Undoubtedly we only under stand completely that which is, when we recognize and make clear to ourselves how it came to be. But how it came to be, we recognize only if we investigate and understand, as exactly as possible, how it is. Our grasping that which came to be and comprehending its becoming is only one form and expression of our understanding of the present and existing. And this becoming and having come to be can be derived only by temporally conceiving and analysing the existing in order to understand it. ' We must, therefore, center our attention on what may be called the structure and logic of social order.

The first in-depth, comparative study of the development of inheritance law in the United States, France, and Germany, Inherited Wealth investigates longstanding political and intellectual debates over inheritance laws and explains why these laws still differ so greatly among these countries. Using a sociological perspective, Jens Beckert sheds light on the four most controversial issues in inheritance law during the past two centuries: the freedom to dispose of one's property as one wishes, the rights of family members to the wealth bequeathed, the dissolution of entails (which restrict inheritance to specific classes of heirs), and estate taxation. Beckert shows that while the United States, France, and Germany have all long defended inheritance rights based on the notion of individual property rights, they have justified limitations on inheritance rights in profoundly different ways, reflecting culturally specific ways of understanding the problems of inherited wealth.

Book excerpt: Drawing on the work of Foucault and Bourdieu, David Lindenfeld illuminates the practical imagination as it was exhibited in the transformation of the political and social sciences during the changing conditions of nineteenth-century Germany. Using a wealth of information from state and university archives, private correspondence, and a survey of lecture offerings in German universities, Lindenfeld examines the original group of learned disciplines which originated in eighteenth-century Germany as a curriculum to train state officials in the administration and reform of society and which included economics, statistics, politics, public administration, finance, and state law, as well as agriculture, forestry, and mining. He explores the ways in which some systems of knowledge became extinct, and how new ones came into existence, while other migrated to different subject areas. Lindenfeld argues that these sciences of state developed a technique of deliberation on practical issues such as tax policy and welfare, that serves as a model for contemporary administrations.
