Book excerpt: Excerpt from Citizenship of the United States These laws, substantially the statutes enacted more than a hundred years ago when our population was less than four millions, and when it was the policy of our government to invite immigration, were ill adapted to our modern conditions, with a population of eighty mil lions and an influx of foreigners of more than a million annually. Under these laws lax and unsatisfactory methods of naturalization had grown up, opening the way to gross frauds against our citizenship, including perjury, false impersonation, and traffic in false and counterfeit certificates of citizenship. Such certificates were sometimes sold to alien criminals to secure their ad mission to the United States, and frequently to procure protection against their home governments. Cases have actually occurred where aliens have landed on our shores for the first time, having in their possession certificates entitling them to the full rights of American citizenship. Book excerpt: Excerpt from Higher Nationality: A Study in Law and Ethics IT is with genuine pleasure that I find myself among my fellow-lawyers of the New World. But my satisfaction is tempered by a sense of embarrassment. There is a multitude of topics on which it would be most natural that I should seek to touch. If, however, I am to use to any purpose the opportunity which you have accorded me, I must exclude all but one or two of them. For in an hour like this, as in most other times of endeavour, he who would accomplish any thing must limit himself. What I have to say will therefore be confined to the suggestion of little more than a single thought, and to its development and illustration with materials that lie to hand. I wish to lay before you a result at which I have arrived after reflection, and to submit it for your consideration with such capacity as I possess. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Nationality, Vol. 1 of 2: Including Naturalization and English Law on the High Seas and Beyond the Realm; Nationality and Naturalization In the First Part of this book I have endeavoured to unravel the law of British Nationality, with its allied subject, Naturalization. This law lies almost entirely within the compass of the Naturalization Act of 1870. It has been considered in very few cases. But the fact that questions under this Act come so seldom before the Courts must not be taken to indicate that the existence of doubts as to a person's nationality is of rare occurrence. The nature of the subject is such that difficulties do not often arise before Courts of Law. There must be a multitude of persons who cannot say with certainty whether they are British subjects or not; but their most common trouble arises in the Consulates, and their plaints find their way into the columns of the newspapers. Therefore, the elements which enter into the inquiry should be considered. The first inquiry should be the means by which citizenship is acquired; whether by descent or naturalization; in either one of these two ways citizenship is generally conferred except in cases of adoption by marriage. Municipal rules have value within the territory of their juris diction, but have no extra-territorial effect. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Nationality and Government: With Other War-Time Essays All the essays have been written since the outbreak of the war with one exception, that on Education, Social and National. I have included this partly because it seemed of sufficient intrinsic interest, and partly in order to indicate that my general attitude has not been arrived at under the stress of passing events, but that the war has on the whole confirmed rather than reversed opinions previously formed. On the other hand, I have deliberately refrained from reprinting an essay on Seven Months in America, written in 1912, because, although in some important respects events have borne it out, it did far less than justice to the fundamental unity and idealism of the American Commonwealth. I have also omitted, as unsuited to a book covering so wide a scope, several essays containing a more detailed treatment of some of the issues discussed here. One of them, a study of the problem of women in industry, has already been in part reprinted. Others may perhaps see the light in another form. In reprinting, as from my own pen, articles which have appeared in the Round Table, I take the opportunity of thanking the friends in collaboration with whom they were written. Now that the book as a whole is before me, I may add a few words of prefatory comment. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Union Foundations: A Study of American Nationality as a Fact of Science As the following discussion of the scientific bases on which our nationality has rested and must rest, was written in September, 1862, the partial coincidence of certain views herein set forth with those embodied in a portion of the President's Message of December, 1862, must be regarded as a natural agreement, and as an evidence that these views are truthful and necessary results of candid study. The Editor's Table of Harper's Magazine, for February, 1863, contains a condensed re-casting, by an able hand, of many facts and views presented in this study, and I can but hope that the popular audience thus reached, as well as the readers of the following pages, may find therein, not only food for reflection, but new courage, and new hope, amid the gloom and distraction of a trying hour. Book excerpt: On America's western frontier, myths of prosperity concealed the brutal conditions endured by women, slaves, orphans, and the poor. As poverty and unrest took root in eighteenth-century Kentucky, western lawmakers championed ideas about whiteness, manhood, and patriarchal authority to help stabilize a politically fractious frontier. Honor Sachs combines rigorous scholarship with an engaging narrative to examine how conditions in Kentucky facilitated the expansion of rights for white men in ways that would become a model for citizenship in the country as a whole. Endorsed by many prominent western historians, this groundbreaking work is a major contribution to frontier scholarship.
