Available in PDF, EPUB and Kindle. Book excerpt: Over the last generation, the United States has undergone seismic changes. Stable institutions have given way to frictionless transactions, which are celebrated no matter what collateral damage they generate. The concentration of great wealth has coincided with the fraying of social ties and the rise of inequality. How did all this come about? In Transaction Man, Nicholas Lemann explains the United States’—and the world’s—great transformation by examining three remarkable individuals who epitomized and helped create their eras. Adolf Berle, Franklin Delano Roosevelt’s chief theorist of the economy, imagined a society dominated by large corporations, which a newly powerful federal government had forced to become benign and stable institutions, contributing to the public good by offering stable employment and generous pensions. By the 1970s, the corporations’ large stockholders grew restive under this regime, and their chief theoretician, Harvard Business School’s Michael Jensen, insisted that firms should maximize shareholder value, whatever the consequences. Today, Silicon Valley titans such as the LinkedIn cofounder and venture capitalist Reid Hoffman hope “networks” can reknit our social fabric. Lemann interweaves these fresh and vivid profiles with a history of the Morgan Stanley investment bank from the 1930s through the financial crisis of 2008, while also tracking the rise and fall of a working-class Chicago neighborhood and the family-run car dealerships at its heart. Incisive and sweeping, Transaction Man is the definitive account of the reengineering of America—with enormous consequences for all of us.

Available in PDF, EPUB and Kindle. Book excerpt: In this book, Alex J. Ramos examines production, consumption, and transaction in the regional economy of Galilee during the Early Roman period. Drawing on literary sources—including biblical texts, Josephus, and the Mishnah—and archaeological evidence, he assesses the ways that the Roman and Herodian states, settlement patterns, and Jewish religious obligations would have shaped household economic behavior. Approaching the topic through new institutional economics, Ramos considers the role of state institutions of administration and taxation and religious institutions derived from the Torah and the Temple in structuring for Galilean Jews the incentives, priorities, and costs of economic decision making. In contrast to classical economic assumptions of what is economically “rational” behavior, he considers the ways that the laws of the Torah defined the bounds of rational and socially permissible approaches to economic production, consumption, and transaction. Ultimately, Ramos argues that state institutions played a rather indirect and weak role in shaping the economy through much of the Early Roman Galilee; religious institutions, by comparison, played a more formative role in defining economic behavior.

Available in PDF, EPUB and Kindle. Book excerpt: From tabloid exposes of child prostitution to the grisly tales of Jack the Ripper, narratives of sexual danger pulsated through Victorian London. Expertly blending social history and cultural criticism, Judith Walkowitz shows how these narratives reveal the complex dramas of power, politics, and sexuality that were being played out in late nineteenth-century Britain, and how they influenced the language of politics, journalism, and fiction. Victorian London was a world where long-standing traditions of class and gender were challenged by a range of public spectacles, mass media scandals, new commercial spaces, and a proliferation of new sexual categories and identities. In the midst of this changing culture, women of many classes challenged the traditional privileges of elite males and asserted their presence in the public domain. An important catalyst in this conflict, argues Walkowitz, was W. T. Stead's widely read 1885 article about child prostitution. Capitalizing on the uproar caused by the piece and the volatile political climate of the time, women spoke of sexual danger, articulating their own grievances against men, inserting themselves into the public discussion of sex to an unprecedented extent, and gaining new entree to public spaces and journalistic practices. The ultimate manifestation of class anxiety and gender antagonism came in 1888 with the tabloid tales of Jack the Ripper. In between, there were quotidien stories of sexual possibility and urban adventure, and Walkowitz examines them all, showing how women were not simply figures in the imaginary landscape of male spectators, but also central actors in the stories of metropolotin life that reverberated in courtrooms, learned journals, drawing rooms, street corners, and in the letters columns of the daily press. A model of cultural history, this ambitious book will stimulate and enlighten readers across a broad range of interests.

Book excerpt: In this study, Jennifer Riddle Harding presents a cognitive analysis of three figures of speech that have readily identifiable forms: similes, puns, and counterfactuals. Harding argues that when deployed in literary narrative, these forms have narrative functions—such as the depiction of conscious experiences, allegorical meanings, and alternative plots—uniquely developed by these more visible figures of speech. Metaphors, by contrast, are often "invisible" in the formal structure of a text. With a solid cognitive grounding, Harding’s approach emphasizes the relationship between figurative forms and narrative effects. Harding demonstrates the literary functions of previously neglected figures of speech, and the potential for a unified approach to a topic that crosses cognitive disciplines. Her work has implications for the rhetorical approach to figures of speech, for cognitive disciplines, and for the studies of literature, rhetoric, and narrative.

Available in PDF, EPUB and Kindle. Book excerpt: A literary scholar and investment banker applies economic criticism to canonical novels, dramatically changing the way we read these classics and proposing a new model for how economics can inform literary analysis. Every writer is a player in the marketplace for literature. Jonathan Paine locates the economics ingrained within the stories themselves, revealing how a text provides a record of its author’s attempt to sell the story to his or her readers. An unusual literary scholar with a background in finance, Paine mines stories for evidence of the conditions of their production. Through his wholly original reading, Balzac’s The Splendors and Miseries of Courtesans becomes a secret diary of its author’s struggles to cope with the commercializing influence of serial publication in newspapers. The Brothers Karamazov transforms into a story of Dostoevsky’s sequential bets with his readers, present and future, about how to write a novel. Zola’s Money documents the rise of big business and is itself a product of Zola’s own big business, his factory of novels. Combining close readings with detailed analyses of the nineteenth-century publishing contexts in which prose fiction first became a product, Selling the Story shows how the business of literature affects even literary devices such as genre, plot, and repetition. Paine argues that no book can be properly understood without reference to its point of sale: the author’s knowledge of the market, of reader expectations, and of his or her own efforts to define and achieve literary value.

Available in PDF, EPUB and Kindle. Book excerpt: "Boilerplate language in contracts tends to stick around long after its origins and purpose have been forgotten. Usually there are no serious repercussions, but sometimes it can cause unexpected problems. Such was the case with the obscure pari passu clause in cross-border sovereign debt contracts, when a Belgian court's novel judicial interpretation in Elliott Associates v. Peru rattled international finance by forcing a defaulting sovereign - for one of the first times in the market's centuries-long history - to repay its foreign creditors despite their refusal to enter into a restructuring agreement. Though neither party wanted this outcome, the vast majority of contracts subsequently issued demonstrate virtually no attempt to clarify the imprecise language of the clause. Using this case as a launching pad to explore the broader issue of 'stickiness' of contract boilerplate, Mitu Gulati and Robert E. Scott have sifted through more than one thousand sovereign debt contracts - dating back to the nineteenth century - and interviewed hundreds of practitioners to show that the problem actually lies in the nature of the modern corporate law firm. The financial pressure on large firms to maintain a high volume of transactions contributes to an array of problems that deter innovation and that are largely hidden from the individual lawyer tasked with drafting contracts. With the near certainty of massive sovereign debt structuring in Europe, The Three and a Half Minute Transaction speaks to critical issues facing the industry and has broader implications for contract design that will ensure it remains relevant to our understanding of legal practice long after the debt crisis has subsided"--Unedited summary from book jacket.
