Book excerpt: The complaint against Mr Brian Binley, MP for Northampton South, was that he claimed against the Additional Costs Allowance (ACA) for a property in Pimlico, London, which he rented from a company in which he and his wife have an interest. This rental was from February 2006 until April 2009. The Department of Finance and Administration (DFA) had approved his plans in November 2005, but the rules changed in 2006 and the DFA informed Mr Binley in March 2006 that it was no longer able to approve the proposed arrangements. He challenged this decision, and it was agreed in June 2006 that he could claim until the end of the 2006-07 financial year but would then have to make alternative arrangements. The Commissioner for Standards found that Mr Binley took no significant action until February 2008. After further discussion and appeals in 2008 and 2009, it was agreed that the House would continue to meet the costs of renting the flat until 30 April 2009. Mr Binley vacated it on 25 April 2009. The Commissioner found that Mr Binley had breached the rules from March 2007 until April 2009 because he did not act on the DFA's clear instructions in June 2006. The Committee agrees he has breached the rules, and must apologise unequivocally in writing and repay a sum of £1500. The fact that he made no personal financial gain, and that the DFA had failed to enforce its ruling of June 2006, are mitigating factors.

Post Office Ltd should be clearer in its approach to public consultation about closures. The Committee is also concerned that access criteria - proximity of population to offices, local transport and geographical constraints - have not been fully taken into account, nor the principle of services being fully accessible to all. The process has been improving with more experience, but there is still room for further improvement and clarity.

(Authors opting for Green open access publish in any subscription journal, and then make their peer-reviewed final draft freely accessible online by self-archiving or depositing the article in a repository (either institutional or disciplinary) upon acceptance for publication.) The Committee made the unusual decision to take oral evidence from Post Office Ltd and Postwatch between publishing its sixth report and receiving the Government response. This evidence has confirmed two of the Committee's concerns: the costs to Post Office Ltd of delivering Royal Mail Group services; and the financial support to sub-postmasters for providing outreach services. Royal Mail Group and Post Office Ltd should provide clear information on: what services Royal Mail Group expects Post Office Ltd to deliver for it; how Royal Mail Group determines the price it pays for these services; and how much it actually currently costs Post Office Ltd to deliver them. The Committee remains concerned that the funding provided for outreach services may be inadequate, and recommend that the National Audit Office investigate the financial arrangements for outreach services.

As a member of the House of Lords he is unable to answer questions in the House of Commons. The report compares the current situation with previous examples of Cabinet ministers being in the House of Lords. The Committee notes that the current situation differs from the past in that a significant proportion of the ministerial support team is based in the Lords or shared with other departments. It is unfortunate that the department for business is so thinly represented in the Commons. One solution would be to amend Standing Orders to allow Lord Mandelson to appear at the Despatch Box to answer questions in the Commons. There are precedents for this approach. Such a change might, though, encourage governments to appoint more members of the House of Lords as department heads, and the Committee feels that would be an unwelcome and significant constitutional change. The Procedure Committee should investigate a mechanism for parliamentary questions to the Secretary of State for Business, Enterprise and Regulatory Reform.

It welcomes the lowering of the limit of the Scheme from £5 million to £1 million, in line with its recommendation made in July, but is deeply concerned that not a single loan or loan guarantee has been made under the programme. The Committee calls on the Government to expedite its negotiations, and prove to the Committee and the automotive industry that the Scheme can provide tangible benefits to companies in the sector.

It urges the government to "reconsider funding widening participation in higher education through a programme similar to the 'pupil premium'." The committee also concluded that "focusing financial support on providing money for living costs to students while they are studying would be a more effective means of support than fee-waivers and would be more consistent with the message that students should not be dissuaded from applying to university because of the cost." and recommends that the National Scholarship Programme be refocused accordingly. Furthermore reforms are not yet complete with a number of consultation exercises currently out for responses, including early repayment penalties for loans, the future of student number controls, loans for students studying at alternative providers, "off quota" students and a new regulatory framework for new and alternative providers. The detail to be required in the Key Information Sets has yet to be finalised. There will also need to be changes to both OFFA and HEFCE to reflect their changing responsibilities in higher education. The committee highlights the fact that the new fee regime is to start at the beginning of the next academic year and there is concern that the necessary coherent package of reforms be delivered to that timetable. The report also stresses that the reforms should be implemented as a package and not in a piecemeal way
