Book excerpt: The deployment of Autonomous Weapons gives rise to ongoing debate in society and at the United Nations, in the context of the Convention on Certain Conventional Weapons. Yet little empirical research has been done on this topic. This volume fills that gap by offering an empirical study based on military personnel and civilians working at the Dutch Ministry of Defence. It yields insight into how Autonomous Weapons are perceived by the military and general public; and which moral values are considered important in relation to their deployment. The research approach used is the Value-Sensitive Design (VSD) method that allows for the consideration of human values throughout the design process of technology. The outcome indicates that military personnel and civilians attribute more agency (the capacity to think and plan) to an Autonomous Weapon than to a Human Operated Drone. In addition, it is clear that common ground exists between military and societal groups in their perception of the values of human dignity and anxiety. These two values arise often in the discourse, and addressing them is essential when considering the ethics of the deployment of Autonomous Weapons. This volume proposes a radical new way of answering this question. It rests on a non-representational theory of knowledge on how to approach and understand the self and action more broadly. Although it has never been lost, the Aristotelian emphasis on excellence in moral character and practical reason as preconditions for achieving happiness has gradually been degraded. This book suggests that this has happened thanks to a split between knowledge and action that can be traced back to the origins of modernity. Modern academic disciplines in general, and psychology in particular, are based on the idealisation of theoretical, hypothetical and abstract reason, suggesting that this morally neutral ideal must guide human action. This volume systematically integrates those domains in a more profound and meaningful proposal, relevant for current times and challenges. Based on previous research bridging philosophy, psychology and neuroscience, the contributors here identify two alternative paradigms for conceiving of the self and human development: the so-called “autonomous self” (AS) and the “inter-processual self” (IPS). The book considers the person as an ethical being and as the foundational cornerstone of a new theory of self, action and knowing that achieves decisive distance from modern theory’s limitations. To keep on-going dialogue on human development open, the authors introduce a new theoretical model (IPS) which can be scientifically measured and tested; they also suggest its further application in concrete, practical realms, thus touching on how the adoption of the IPS paradigm inspires a renewed view of human cognition, education, governance, and business management.

National legal systems, which usually have no extraterritorial authority, remain insufficient to regulate the activities of multinational corporate groups, which operate worldwide, not only in the countries where the parent companies reside (home country), but also in countries where the subsidiaries operate (host countries). The mentioned lack of an effective legislation leads to an unjust imbalance – to the benefit of multinational corporate groups and to the detriment, especially, of involuntary creditors, such as tort victims of corporate activities, which predominantly concern human rights abuses and environmental violations. Against this backdrop, the book firstly assesses the position of multinational corporate groups in international law and then discusses potential reforms to corporate law that would allow for a multi-stakeholder approach. It analyses certain aspects of Turkish tort law that could potentially accommodate liability claims against the parent companies of multinational corporate groups for damage incurred due to their transnational subsidiaries’ activities (referred to as ‘foreign direct liability’ in legal doctrine). To this end, the potential legal grounds of fault liability and strict liability are assessed under Turkish law, with a particular focus on the duty of care, in comparison with the corresponding case law in the UK and the Netherlands. Mandatory human rights due diligence is also analysed with a view to proposing a new regulation in Turkish law. Lastly, the aspects of foreign direct liability claims related to private international law are assessed in order to answer the questions of jurisdiction and applicable law within the scope of a comparative legal study.

This implies that talk of corporate moral responsibilities, beyond the mere metaphorical, is essentially meaningless. Part two takes the fallacy of corporate moral agency as its premise and spells out its implications.
