Book excerpt: Although expert psychological testimony it is not present in every trial, it has the potential to greatly influence the outcome of trials when it is used. As such, it is important to understand factors that influence how jurors receive psychological testimony. Yet before expert testimony is presented, an attorney must hire the expert. This process of selection requires further scrutiny, as it is possible that persuasive and qualified experts never make it before a jury. Gender is a factor that has the potential to bias both jurors and attorneys despite being unrelated to expert qualifications. This study examined whether expert sex impacts juror and lawyer perceptions of expert credibility, as well as whether this perceived credibility is impacted by the gendered nature of the crime in question. It was hypothesized that lawyers who found experts more credible, or believe the jury will perceive them as more credible, would be more likely to use them. It was further presumed that jurors who believe an expert to be more credible might be more persuaded by the expert's testimony. Results indicated that the most salient characteristic presented in the case vignettes was neither the expert sex nor the gender of the defendant, but rather the circumstances of the crime committed. There was some indication the gendered nature of the crime interacted with the gender of the defendant to influence expert credibility, but this effect was independent of the expert's sex.

However, their impact on fact finders' perceptions is yet to be understood. The current research examined adults' perceptions of youth testifying via a language interpreter. (N =302) English-speaking participants in Study 1 and (N = 464) Spanish-speaking participants in Study 2 listened to two mock investigative interviews, one with a 7-year-old child and one with a 14-year-old adolescent. Half listened to interpreter-mediated interviews in a language in which the participant was not proficient (i.e., Spanish or English). Findings indicate that verbatim translations of the testimony resulted in differences in how mock jurors perceived young witnesses, the interviewer, and interview as a whole. For example, youth who testified via a language interpreter were rated as calmer and more comfortable with the interviewer than in typical interviews. The current study has implications for understanding jurors' perceptions of non-native language-speaking children and adolescents.

Book excerpt: The current projects investigated the efficacy of inoculation as a trial strategy designed to counter mock jurors' perceptions that an expert is a hired gun. Additionally, the projects also examined whether the manner in which experts responded to these questions had a significant effect on their ratings as a hired gun and overall credibility. The project contained two independent studies with parallel manipulations. Study 1 examined the previously mentioned effects in a civil trial while study 2 examined them in a criminal trial. The effects of these variables on measures of case outcome were also examined. Results revealed that, in a civil setting, inoculation significantly affected mock jurors' views of psychology in general, but had no significant effect on ratings of the expert as a hired gun, expert credibility, or case outcome. However, experts who responded to questions about bias in a narrative versus a fragmented manner were viewed as less of a hired gun. These results were not replicated in the criminal context. In that setting, not using inoculation led to higher ratings of expert knowledge. No other significant effects of inoculation or response style were found in the criminal setting. Implications of these results regarding current theory about hired gun expert witnesses are discussed. Additionally, suggestions for the fields of trial strategy and expert witness testimony are made. Finally, due to the context dependent nature of the results that were obtained, these findings suggest that future research in this area should be wary to generalize findings from a civil context to a criminal context and vice versa.
