This book evaluates the extent to which constitutionalism, as an empirical idea and normative ideal, can be adapted to institutions beyond the state by surveying the sophisticated legal and political system of the European Union. Having originated in a series of agreements between states, the EU has acquired important constitutional features like judicial review, protections for individual rights, and a hierarchy of norms. Nonetheless, it confounds traditional models of constitutional rule to the extent that its claim to authority rests on the promise of economic prosperity and technocratic competence rather than on the democratic will of citizens. Critically appraising the European Union and its legal system, this book proposes the idea of 'functional constitutionalism' to describe this distinctive configuration of public power. Although the EU is the most advanced instance of functional constitutionalism to date, understanding this pragmatic mode of constitutional authority is essential for assessing contemporary international economic governance.

Trade and Commerce fills this gap by bringing to light a lost understanding of how the Constitution structures economic relations. As Malcolm Lavoie reveals, the Constitution includes foundational commitments to property rights, local government autonomy, and the principle of subsidiarity. At the same time, it creates a platform for integrated national markets with secure channels for interprovincial trade. This economic vision remains a vital part of Canada’s constitutional order and is relevant to a purposive interpretation of the Constitution. But contemporary legal discourse has begun to lose touch with this vision, with regrettable consequences in a number of different policy areas. Book excerpt: Federalism is about dividing and sharing government, often in complex ways that involve some tasks being done jointly. Are federal systems capable of effective joint policy-making? Is this possible in the fast-moving context of globalization? In Market Rules Douglas Brown examines these questions through a comparative study of Australia and Canada, looking at recent major reforms to the economic union in the two federations and comparing them with the evolving European Union (EU). Brown argues that internal barriers to trade and competition in these countries were significant obstacles to competition in the global economy and shows that the old market rules were rooted in longstanding political and regional compromises. He describes the process of detailed and difficult intergovernmental collaboration required for the EU, and now Canada and Australia, to produce new market rules. The resulting reforms created new regimes that provide deeper and broader national economic integration in Canada and Australia than in the EU. The new rules entrench neo-liberal values, retaining some room for diversity and flexibility for equity goals. Built on a careful analysis of the differences and similarities in political economy, constitutional design, federal culture, and history of intergovernmental relations in Canada and Australia, Market Rules provides fresh evidence that federal states can be strong and autonomous in the global society, while underscoring the conditions for effective collaboration that make this sustainable. The unresolved tensions that arise between the two are only beginning to be addressed by judges. Are courts resisting these new international limitations on their constitutional space? Constitutional Review and International Investment Law: Deference or Defiance? pioneers this discussion by examining how a selection of the highest courts around the world have addressed this potential discord. A comparison of decisions in the US, Europe, Colombia, Indonesia, Israel, and elsewhere reveals that, rather than issuing declarations of constitutional incompatibility, courts are more likely to respond to constitutional tensions indirectly. Their rulings adopt stances that range from hard deference (such as the Peruvian Constitutional Court viewing constitutional law and investment law as entirely compatible) to soft defiance (for example the Colombian Constitutional Court requiring only modest renegotiation of some treaty terms so that they are constitutionally compliant). Readers learn that judges are not aiming to undermine the investment law regime but are seeking to mitigate constitutional collision.
