Book excerpt: The Committee reported in 2007 (17th report session 2006-07, HL paper 79-I, ISBN 9780104010549) on the proposal from the European Commission to introduce a price cap on voice roaming charges for using mobile phones across the EU. The Regulation was adopted in June 2007, and in September 2008 the Commission proposed amending it. This report examines the proposed amendments which cover caps for text message roaming and data roaming (downloading internet content to a mobile device such as a laptop or mobile phone). The Committee feels the Commission should gather more evidence to support the proposals. The sunset clause, whereby the regulation remains in force for the minimum time required (the proposal is to amend this to 2013), is still supported by the Committee, but it must be combined with better data collection as such data is critical to reviewing the effectiveness of the Regulation. The Committee is concerned at the extension of the regulation to text message and data roaming so soon after it came into effect for voice roaming, when it has not yet proved to be effective for voice roaming and without a robust evidence base. It believes that the text message and data roaming charges are likely to be excessive.

This book was released on 2007-04-23 with total page 42 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report looks at the proposal from the European Commission to introduce a price cap on roaming charges for using mobile phones across the EU. It concludes that there is evidence of a market failure in roaming charges and, because the service is cross-border in nature, it is appropriate for action to be taken at the Community level. However the Committee has some reservations about the Commission's proposal and favour regulation at the wholesale end rather charges to the retail customer. It thinks that regulation based on the average wholesale price would allow companies to offer a range of charges, provide a competitive framework and avoid market rigidities. The Committee believes the regulation should apply for a minimum amount of time and there should be a 'sunset clause'. The proposals are limited to voice messages but there are also market abuses in data roaming and the Commission should consider extending the regulations to these services.

Book Synopsis Time, Law, and Change by : Sofia Ranchordás
Download or read book Time, Law, and Change written by Sofia Ranchordás and published by Bloomsbury Publishing. This book was released on 2020-04-16 with total page 407 pages. Available in PDF, EPUB and Kindle. Book excerpt: Offering a unique perspective on an overlooked subject – the relationship between time, change, and lawmaking – this edited collection brings together world-leading experts to consider how time considerations and social, political and technological change affect the legislative process, the interpretation of laws, the definition of the powers of the government and the ability of legal orders to promote innovation. Divided into four parts, each part considers a different form of interaction between time and law, and change. The first part offers legal, theoretical and historical perspectives on the relationship between time and law, and how time shaped law and influences legal interpretation and constitutional change. The second part offers the reader an analysis of the different ways in which courts approach the impact of time on law, as well as theoretical and empirical reflections upon the meaning of the principle of legal certainty, legitimate expectations and the influence of law over time. The third part of the book analyses how legislation and the legislative process addresses time and change, and the various challenges they create to the legal order. The fourth and final part addresses the complex relationship between fast-paced technological change and the regulation of innovations.

Book Synopsis The Constitutional Value of Sunset Clauses by : Antonios Emmanouil Kouroutakis
Download or read book The Constitutional Value of Sunset Clauses written by Antonios Emmanouil Kouroutakis and published by Taylor & Francis. This book was released on 2016-10-04 with total page 213 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years, sunset clauses have mostly been associated with emergency legislation introduced in the wake of terrorist attacks. However, as this book demonstrates, they have a long history and a substantial constitutional impact on the separation of powers and the rule of law. In addition, the constitutional value of such clauses is examined from certain neglected normative aspects pertaining to concepts such as deliberative and consensus democracy, parliamentary sovereignty and constitutional dialogue. The work is an amalgam of three perspectives: the historical, the positive and the normative. All three are intertwined and each subsequent part builds upon the findings of the previous one. The historical perspective investigates the historical development of sunset clauses since the first Parliaments in England. The positive perspective examines the legal effect and the contemporary utility of sunset clauses. Finally, the normative perspective analyses their interaction with several models of separation of powers, and their influence on the dialogue between various institutions as it values their impact on the rule of law, formal and substantive. The detailed examination of this topical subject will be a valuable resource for academics, researchers and policy makers.

Book Synopsis Europe's Second Constitution by : Markus W. Gehring
Download or read book Europe's Second Constitution written by Markus W. Gehring and published by Cambridge University Press. This book was released on 2020-09-24 with total page 439 pages. Available in PDF, EPUB and Kindle. Book excerpt: The process of European constitutionalisation is met with extensive scepticism in current national legal and political spheres and in broader circles of public opinion across Europe. By shedding light on these concerns, this book reveals a widespread misunderstanding of constitutional federalism, which permeates the Member State courts, popular media, and many academic communities. A failure to address confusion over this fundamental concept is leading us towards impoverished development of the EU's 'Second Constitution', and even ensuring that the role of both domestic and international European courts in enriching the constitutionalisation process is overlooked and undervalued. In a bid to avoid such consequences, this book explores how federalism and further constitutionalisation - rightly understood in a dialogue of the European courts - may actually change this process and allow a clearer advance toward Europe's Second Constitution for, but also with, the people of Europe.
