Available in PDF, EPUB and Kindle. Book excerpt: At the end of the Second World War, a growing concern that Canadians' civil liberties were not adequately protected, coupled with the international revival of the concept of universal human rights, led to a long public campaign to adopt a national bill of rights. While these initial efforts had been only partially successful by the 1960s, they laid the foundation for the radical change in Canadian human rights achieved by Pierre Elliott Trudeau in the 1980s. In Toward the Charter Christopher MacLennan explores the origins of this dramatic revolution in Canadian human rights, from its beginnings in the Great Depression to the critical developments of the 1960s. Drawing heavily on the experiences of a diverse range of human rights advocates, the author provides a detailed account of the various efforts to resist the abuse of civil liberties at the hands of the federal government and provincial legislatures and the resulting campaign for a national bill of rights. The important roles played by parliamentarians such as John Diefenbaker and academics such as F.R. Scott are placed alongside those of trade unionists, women, and a long list of individuals representing Canada's multicultural groups to reveal the diversity of the bill of rights movement. At the same time MacLennan weaves Canadian-made arguments for a bill of rights with ideas from the international human rights movement led by the United Nations to show that the Canadian experience can only be understood within a wider, global context.

Available in PDF, EPUB and Kindle. Book excerpt: How did France and Australia develop a deep strategic partnership, when only about two decades ago, a group of Australians bombed the French consulate in Perth to protest against French nuclear testing in the Pacific? Which interests, which personalities, which elements of the global context have led France and Australia to engage in a regional and global rapprochement, and what have been the human, economic and political prerequisites which enabled it? This book aims to investigate the dynamics behind this historically ambiguous relationship. More precisely, this study explains why and how France and Australia are currently engaged in a process of strategic and economic mutual empowerment and how this rapprochement has been possible, owing to thirty years of diplomatic efforts to overcome ongoing culturally and historically constructed misunderstandings and conflicts. This book demonstrates how French and Australian foreign policy-makers have understood that, in regard to their numerous common interests, both countries had to mutually empower each other in order to strengthen their own power, regionally and globally. This book argues that these inclusive dynamics of empowerment constitute the response of two diverse middle powers to current global threats and represent a tool suitable for modernising the strategies and practices of both countries’ diplomacies. Soyez’ research is the first to propose an answer to these questions through the development of the French-Australian strategic partnership.

We've witnessed the UK's exit from the EU, further devolution to Scotland and Wales, a number of prominent cases by the Supreme Court, two early parliamentary general elections, major governmental defeats and two Prime Ministerial resignations. Alison Young has built on the text of Colin Turpin and Adam Tomkins' earlier edition, keeping their unique historical and contextual approach, whilst bringing the material up to date with more contemporary examples, including references to Brexit, the recent prorogation and Brexit case law, and the Covid-19 pandemic. The book continues to include substantial extracts from parliamentary and other political sources as well as from legislation and case law. It also provides a full yet accessible account of the British constitution at the culmination of a series of dramatic events, on the threshold of possible further constitutional reform.

German reunifi cation had never happened? the Conservatives had won an overall majority in 2010? Lyndon Johnson had been shot down in 1942? David Miliband had beaten Ed Miliband to the Labour leadership? Lynton Crosby had changed sides in 2015? or Boris Johnson had become Prime Minister after the European referendum? Welcome to the world of political counterfactuals, where scholarly analyses of possibilities and causalities take their place beside enthralling fictional accounts of alternate political histories - all guaranteed to enlighten and entertain (or make you shudder at the thought). From a permanent union between France and the UK in 1940, to a 'Yes' vote in the Scottish independence referendum of 2014, to Jeremy Corbyn becoming Prime Minister in 2020, get ready to see a century of political history turned on its head with twenty-three expert examinations of things that never happened (or likely never will) - but easily could have if events had so conspired...

Available in PDF, EPUB and Kindle. Book excerpt: This book undertakes unique case studies, including interviews with participants, as well as empirical analysis, of public and private enforcement of Australian securities laws addressing continuous disclosure. Enforcement of laws is crucial to effective regulation. Historically, enforcement was the province of a government regulator with significant discretion (public enforcement). However, more and more citizens are being expected to take action themselves (private enforcement). Consistent with regulatory pluralism, public and private enforcement exist in parallel, with the capacity to both help and hinder each other, and the achievement of the goals of enforcement in a range of areas of regulation. The rise of the shareholder class action in Australia, backed by litigation funding or lawyers, has given rise to enforcement overlapping with that of the government regulator, the Australian Securities and Investments Commission. The ramifications of overlapping enforcement are explained based on detailed analysis. The analysis is further bolstered by the regulator's approach to enforcement changing from a compliance orientation to a “Why not litigate?” approach. The analysis and ramifications of the Australian case studies involve matters of regulatory theory and practice that apply across jurisdictions. The book will appeal to practitioners, regulators and academics interested in regulatory policy and enforcement, and the operation of regulators and class actions, including their interaction.
