Book Synopsis Minerals Investment Under the Shari'A Law by : Walied El-Malik
Download or read book Minerals Investment Under the Shari'A Law written by Walied El-Malik and published by Springer. This book was released on 1993-06-15 with total page 166 pages. Available in PDF, EPUB and Kindle. Book excerpt: Starting with a survey of the sources of Islamic law, the book questions the capacity of Islamic law to develop and to adapt itself to the exigencies of time and place, since, although the rules of the holy Quran are eternal and immutable, yet they can well be interpreted to suit fresh situations. The author argues that, although private ownership of minerals is permissible under Islamic law, it is the consensus of the Muslim dilemma that state ownership of minerals is the best concept to be adopted by states in the public interest. He goes on to discuss state participation in mineral activities, types of agreements, methods of finance and how the shari'a laws fit into a well organized subject like the modern mineral industry. Finally, in regard to the protection of investors, Muslims and non-Muslims, under Islamic law, the author illustrates that investors are well protected and that no Muslim ruler has the right to deprive them of their property as long as they are performing their obligations. Unlike international law, under Islamic law public interest alone does not justify the taking of private property. Settlement of disputes and the attitude of shari'a towards modern international arbitration are examined.

Book excerpt: Lex Petrolea and International Investment Law: Law and Practice in the Persian Gulf offers readers a detailed analysis of jurisprudence on the settlement of upstream petroleum disputes between host states in the Persian Gulf and foreign investors. Dr Nima Mersadi Tabari considers the historical, political, and socio-economic roots of the existing frameworks and levels of protection offered to foreign investors. With particular focus on petroleum-related disputes, he initially delivers a comprehensive survey of the jurisprudence of international investment law and investment treaty arbitration. Book Synopsis The Environmental Dimensions of Islam by : Mūʼil Yūsuf ʻIzz al-Dīn
Download or read book The Environmental Dimensions of Islam written by Mūʼil Yūsuf ʻIzz al-Dīn and published by James Clarke & Co.. This book was released on 2000 with total page 226 pages. Available in PDF, EPUB and Kindle. Book excerpt: Islamic attitudes are of increasing concern to the Western world and environmental issues claim much attention as well. Perhaps, though, few non-Muslims realise that there is a distinctive Islamic contribution to the environmental debate; consequently, it provides a much needed Islamic input into the world-wide process of consultation on the future of the planet. Born from the 1992 Earth Summit, this book is a major account of Islam's contribution to the environmental debate. Dr Izzi Dien viewsthe topic from historical, theological, philosophical, legal and ethical perspectives, examining such aspects as the Quranic doctrine of Creation, human responsibility and the actions of governments. His conclusions will not only be an invaluable submission to ecological groups but enlighten the general public, both inside and outside the Islamic community, about Muslim teaching on this area. The Environmental Dimensions of Islam is an important book, touching on issues of community, empowerment and culture. It will challenge those of all faiths and none to reconsider their attitudes towards both the Islamic and the natural world.
Book Synopsis The Law and Governance of Mining and Minerals by : Ana Elizabeth Bastida
Download or read book The Law and Governance of Mining and Minerals written by Ana Elizabeth Bastida and published by Bloomsbury Publishing. This book was released on 2020-12-10 with total page 266 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores a disciplinary matrix for the study of the law and governance concerning mining and minerals from a global perspective. The book considers the key challenges of achieving the goals of Agenda 2030 and the transition to low-carbon circular economies. The perspective encompasses the multi-faceted and highly complex interaction of multiple fields of international law and policy, soft law and standards, domestic laws and regulations as well as local levels of ordering of social relations. What emerges is a largely neglected, unsystematised and under-theorised field of study which lies at the intersection of the global economy, environmental sustainability, human rights and social equity. But it also underlies the many loopholes to address at all levels, most notably at the local level – land and land holders, artisanal miners, ecosystems, local economies, local linkages and development. The book calls for a truly cosmopolitan academic discipline to be built and identifies challenges to do so. It also sets a research agenda for further studies in this fast-changing field.
Book Synopsis International Law and Islamic Law by : MashoodA. Baderin
Download or read book International Law and Islamic Law written by MashoodA. Baderin and published by Routledge. This book was released on 2017-07-05 with total page 993 pages. Available in PDF, EPUB and Kindle. Book excerpt: The relationship between modern international law and Islamic law has raised many theoretical and practical questions that cannot be ignored in the contemporary study and understanding of both international law and Islamic law. The significance and relevance of this relationship in both academic and practical terms, especially after the terrorist attacks of 11 September 2001, is now well understood. Recent international events in particular corroborate the need for a better understanding of the relationship between contemporary international law and Islamic law and how their interaction can be explored and improved to enhance modern international relations and international law. The articles reproduced in this volume examine the issues of General Principles of International Law, International Use of Force, International Humanitarian Law, International Terrorism, International Protection of Diplomats, International Environmental and Water Law, Universality of Human Rights, Women's Rights, Rights of the Child, Rights of Religious Minorities, and State Practice. The essays have been carefully selected to reflect, as much as possible, the different Islamic perspectives on each of these aspects of international law.
