Assess and compare military court-martial conviction rates for adult sexual assault crimes with those in the Federal and State courts for similar offenses and the reasons for any differences. Identify best practices from civilian jurisdictions that may be incorporated into any phase of the military system. Assess the strengths and weaknesses of current and proposed legislative initiatives to modify the administration of military justice and the investigation, prosecution, and adjudication of adult sexual assault crimes. Assess how the name, if known, and other necessary identifying information of an alleged offender collected as part of a restricted report could be compiled into a protected, searchable database accessible only to military criminal investigators, Sexual Assault Response Coordinators, or other appropriate personnel only for the purposes of identifying individual subjects of multiple accusations of sexual assault and encouraging victims to make an unrestricted report in those cases in order to facilitate increased prosecutions, particularly of serial offenders. Assess opportunities for clemency provided in the military and civilian systems, the appropriateness of clemency proceedings in the military system, the manner in which clemency is used in the military system, and whether clemency in the military justice system could be reserved until the end of the military appeals process.

The issue of sex discrimination involves female Service members, who represent 14 percent of the military population, but are disproportionately likely to be victims at a rate five times that of their male counterparts. The questions related to a possible denial of equal protection in the administration of justice led the Commission to examine cases in which sexual assault victims, as well as Service members accused of sexual assault, claim unfair treatment in the military justice system.Through this report, the Commission sheds light on the scope, response, investigation, and discipline of sexual assault in the U.S. military. The Commission held a briefing on January 11, 2013 to hear the testimony of military officials, scholars, advocacy groups, and practitioners on the topic of sexual assault in the military. In response to written questions from the Commission, the Department of Defense and its Armed Services provided documents and other materials, including data on investigated sexual assault allegations, which the Commission analyzed. The results of these efforts are memorialized in this report.The report reveals that the Department of Defense may benefit from greater data collection to better understand trends in sexual assault cases and to implement improvements in future initiatives. Although the Department of Defense has already implemented policies to reduce sexual and sexist material from the military workplace in an effort to reduce sexual harassment, the effects of such recent efforts have yet to be measured. The Department of Defense also has a plan to standardize sexual assault response and prevention training across the Services to promote best practices. There will be a need to track the success of such policies over time. Greater commander accountability for leadership failures to implement such policies, especially in cases where victims claim sexual assault at the hands of superiors within the chain of command, should also be considered. Without increased data collection, however, it is difficult to measure the effects of any new changes the military chooses to implement.

Book excerpt: The report finds DoD has made progress in improving the response to victims' needs, but calls for DoD to do more to fully address the spectrum of sexual assault prevention and response. The task force made a number of recommendations involving DoD's Sexual Assault Prevention and Response Office, including: temporarily elevating oversight of this office to the jurisdiction of the deputy secretary of defense until the program meets established institutional goals; changing the budgeting process to overcome inconsistent funding among the military services; strengthening the policy and oversight functions of the office; calling for collaboration with the military services and national experts in sexual assault prevention to develop a comprehensive prevention strategy and a plan to routinely evaluate it; and more rigorous oversight of military service training programs. The task force found DoD has made demonstrable progress in providing assistance to victims of sexual assault by offering restricted reporting, which permits a victim to obtain immediate care and counseling without engaging law enforcement and command authority. The task force did recommend, however, that Congress should, as a permanent measure, enact a comprehensive military justice privilege for communications between a victim advocate and a victim of sexual assault.
