Available in PDF, EPUB and Kindle. Book excerpt: In most communities, land use regulations are based on a limited model that allows for only one end result: the production of more and more suburbia, composed of endless subdivisions and shopping centers, that ultimately covers every bit of countryside with "improvements." Fortunately, sensible alternatives to this approach do exist, and methods of developing land while at the same time conserving natural areas are available. In Conservation Design for Subdivisions, Randall G. Arendt explores better ways of designing new residential developments than we have typically seen in our communities. He presents a practical handbook for residential developers, site designers, local officials, and landowners that explains how to implement new ideas about land-use planning and environmental protection. Abundantly illustrated with site plans (many of them in color), floor plans, photographs, and renditions of houses and landscapes, it describes a series of simple and straightforward techniques that allows for land-conserving development. The author proposes a step-by-step approach to conserving natural areas by rearranging density on each development parcel as it is being planned so that only half (or less) of the buildable land is turned into houselots and streets. Homes are built in a less land-consumptive manner that allows the balance of property to be permanently protected and added to an interconnected network of green spaces and green corridors. Included in the volume are model zoning and subdivision ordinance provisions that can help citizens and local officials implement these innovative design ideas.

Book excerpt: In an increasingly urbanizing world, the multiple benefits of open space are becoming more important. Yet, despite this importance and many people's recognition of it, efforts to preserve land in open-space uses often fail. Tow main reasons for this are misuse or lack of understanding of the term "open space" and choice of the wrong method for keeping land open.

Available in PDF, EPUB and Kindle. Book excerpt: Urban planning is a community process, the purpose of which is to develop and implement a plan for achieving community goals and objectives. In this process, planners employ a variety of disciplines, including law. However, the law is only an instrument of urban planning, and cannot solve all urban problems or meet all social needs. The ability of the legal system to implement the planning process is limited by philosophical, historical, and constitutional constraints. Jurisprudence is concerned with societal values and relationships that limit the effectiveness of the law as an instrument of urban planning. When law is definite and certain, freedom is enhanced within the boundaries created by the law. This doctrine of Anglo-American law imposes an obligation on courts to be guided by prior judicial decision or precedents and, when deciding similar matters, to follow the previously established rule unless the case is distinguishable due to facts or changed social, political, or economic conditions The author focuses on seven specific areas of law in relation to land use planning: law as an instrument of planning, zoning, exclusionary zoning and managed growth, subdivision regulations, site plan review and planned unit development, eminent domain, and the transfer of development rights. Jerome G. Rose cites more than one hundred court cases, and the indexed list serves as a useful encyclopedia of land use law. This is a valuable sourcebook for all legal experts, urban planners, and government officials.

Book excerpt: Open space in urban regions is fast disappearing, but it can still be saved by coordinating man's design with the processes of nature. The authors demonstrate here methods that permit better and more profitable economic and industrial development, while raising the quality of life and saving the environment. The problem is all around us, David Wallace observes: "As metropolitan areas grow and Megalopolis takes shape before our eyes, nearby open space where nature predominates seems doomed. Forces apparently beyond our control eliminate all traces of an untouched countryside, and replace it with thousands and thousands and thousands of houses. The pattern of ultimate suburban development finally removes the last vestiges of woods, streams, thickets, and wildlife with the filling of vacant lots carelessly left over from the first great surge of growth. The individual houses that result art perhaps pleasant enough in the micro-scale. But unrelievedly continuous urbanization—even in the case where the individual parts are attractive—appalls, bores, and numbs the senses. . . . Must it be this way?" This study, based on research at the Institute of Environmental Studies at the University of Pennsylvania, suggests how the process of indiscriminate exploitation of open space can be reversed through understanding and application of natural processes in the environment. When these natural processes are understood, planners can discriminate among land that should be retained as open space in a natural state, land that can stand limited development, and land that can be fully developed without significantly affecting natural processes. Book excerpt: This book provides an in-depth investigation of the role of the private and public sectors in land markets and regional economics, and explores the reasons behind government intervention in the interests of sustainable growth. The authors explore the subject of regional development and changing land use in a variety of different countries. They examine broad themes such as urban structure, infrastructure and eco-structure, and look in detail at issues including housing, transport and technology clustering. They also demonstrate that for a proper understanding of long-term changes, the broader institutional settings and policy regimes are of critical importance, as it is within this framework that private and public actors interact. It is therefore vital to search for institutional arrangements where conflicts of interest can be dealt with in a constructive way, and where ecological values are taken into consideration. The contributions in this book highlight these difficulties and offer practical proposals to improve current practices. Regional scientists, geographers and development policymakers will welcome this rigorous exploration of the roles of the private and public sectors in the context of economic development.
