Book excerpt: Explore the controversial legal history of the formation of the United States Prestatehood Legal Materials is your one-stop guide to the history and development of law in the U.S. and the change from territory to statehood. Unprecedented in its coverage of territorial government, this book identifies a wide range of available resources from each state to reveal the underlying legal principles that helped form the United States. In this unique publication, a state expert compiles each chapter using his or her own style, culminating in a diverse sourcebook that is interesting as well as informative. In Prestatehood Legal Materials, you will find bibliographies, references, and discussion on a varied list of source materials, including: state codes drafted by Congress county, state, and national archives journals and digests state and federal reports, citations, surveys, and studies books, manuscripts, papers, speeches, and theses town and city records and documents Web sites to help your search for more information and more Prestatehood Legal Materials provides you with brief overviews of state histories from colonization to acceptance into the United States. In this book, you will see how foreign countries controlled the laws of these territories and how these states eventually broke away to govern themselves. The text also covers the legal issues with Native Americans, inter-state and the Mexico and Canadian borders, and the development of the executive, legislative, and judicial branches of state government. This guide focuses on materials that are readily available to historians, political scientists, legal scholars, and researchers. Resources that assist in locating not-so-easily accessible materials are also covered. Special sections focus on the legal resources of colonial New York City and Washington, DC—which is still technically in its prestatehood stage. Due to the enormity of this project, the editor of Prestatehood Legal Materials created a Web page where updates, corrections, additions and more will be posted.

Available in PDF, EPUB and Kindle. Book excerpt: The first full-scale history of the Makah people of the Pacific Northwest, whose culture and identity are closely bound to the sea For the Makahs, a tribal nation at the most northwestern point of the contiguous United States, a deep relationship with the sea is the locus of personal and group identity. Unlike most other indigenous tribes whose lives are tied to lands, the Makah people have long placed marine space at the center of their culture, finding in their own waters the physical and spiritual resources to support themselves. This book is the first to explore the history and identity of the Makahs from the arrival of maritime fur-traders in the eighteenth century through the intervening centuries and to the present day. Joshua L. Reid discovers that the "People of the Cape" were far more involved in shaping the maritime economy of the Pacific Northwest than has been understood. He examines Makah attitudes toward borders and boundaries, their efforts to exercise control over their waters and resources as Europeans and then Americans arrived, and their embrace of modern opportunities and technology to maintain autonomy and resist assimilation. The author also addresses current environmental debates relating to the tribe's customary whaling and fishing rights and illuminates the efforts of the Makahs to regain control over marine space, preserve their marine-oriented identity, and articulate a traditional future.

Book excerpt: In 1932, 60 percent of Washington State voters approved a state income tax. Within less than a year, the measure was struck down as unconstitutional by the state supreme court. Over half a century later, Washington remains one of only eight states without a state income tax. Yet Washington's conflicts and solutions were by no means unique. Through an examination of how Washingtonians reacted to federal tax policy, responded to national debates over tax issues, and opted for particular forms of taxation for themselves and their property, Phil Roberts elucidates the larger patterns of evolving tax policy in the United States.A Penny for the Governor, a Dollar for Uncle Samexplores the complex mix of factors underlying tax decisions and demonstrates how taxation politics influenced (and were influenced by) broader economic and cultural forces from the days of Lincoln to the New Deal. Tax systems are shaped by assumptions about economic development, social responsibility, and government influence, as well as cultural outlooks and political philosophies. This inquiry into the connections between politics and tax policy in the Pacific Northwest contributes to an understanding of the priorities that society holds about the place of government in relation to other institutions, the role government should play in the economic lives of its citizens, and t he relative influence of interest groups on the political process over time.A Penny for the Governor, a Dollar for Uncle Samdemonstrates the roles of governors, legislatures, courts, and average citizens in determining how income taxes were applied or resisted in the Northwest, and the important factors of class and geography in influencing taxation politics. The public debates on the subject are revealing of the role played by urban-rural conflicts in that most fundamental of political issues: taxes -- who decides, who pays, and how much. "A well-written and impressively documented case study of an important and timely topic -- the debate over income taxes, both federal and state, in the Pacific Northwest." -- Michael Allen, University of Washington, Tacoma Phil Robertsis a professor of history at the University of Wyoming.

Available in PDF, EPUB and Kindle. Book excerpt: The conflicts occurring in the Washington Territory in the 1850s provide an interesting case study of the Native American "Indian Wars." It is an excellent story, not only of the conflict itself, but also the interplay between the natives, early settlers, missionaries, and army personalities involved. There is a wealth of contemporary documentation available, but modern histories often center on only certain aspects of those conflicts. Many of the tribes on the Washington coast and in the interior had strong ties with one another and the events of the Washington Territory Indian wars in the Puget Sound area and the Inland Empire area are tied to one another. This is not often been brought together in a single work. This is short history of those conflicts, along with an extensive bibliography of references of both contemporary works and original source material. Most of the sites where the major events that occurred during this conflict are marked today, and a guide to those sites is included.

Available in PDF, EPUB and Kindle. Book excerpt: Gender Remade explores a little-known experiment in gender equality in Washington Territory in the 1870s and 1880s. Building on path-breaking innovations in marital and civil equality, lawmakers extended a long list of political rights and obligations to both men and women, including the right to serve on juries and hold public office. As the territory moved toward statehood, however, jury duty and constitutional co-sovereignty proved to be particularly controversial; in the end, 'modernization' and national integration brought disastrous losses for women until 1910, when political rights were partially restored. Losses to women's sovereignty were profound and enduring - a finding that points, not to rights and powers, but to constitutionalism and the power of social practice as Americans struggled to establish gender equality. Gender Remade is a significant contribution to the understudied legal history of the American West, especially the role that legal culture played in transitioning from territory to statehood.

Available in PDF, EPUB and Kindle. Book excerpt: With the same ability to make personalities and events come alive that characterizes his classic Skid Road, Murray Morgan here tells the colorful story of Tacoma, the City of Destiny, and southern Puget Sound, where many major events of Washingtons history took place. Drawing upon original journals and reports, Morgan builds Pugets Sound around individuals, interweaving portraits of well-known historical figures with those who are more obscure but have a special significance: a colorful parade of saloonkeepers, politicians, union organizers, schemers, and swindlers. Morgan begins his account with the landing of Captain Vancouver in Puget Sound in 1792 and ends with the founding of Fort Lewis in 1916, the year the author was born. Between are the arrival of the transcontinental railroad, the boom-and-bust of lumber mills, the anti-Chinese riots of 1885, and more unique Northwest history that will intrigue both new arrivals and longtime residents. With a new introduction by historian and historic preservationist Michael Sean Sullivan, this redesigned edition of Pugets Sound brings new life to Morgans landmark history of the South Sound and the early days of Tacoma.
