Excerpt: ... and killed her in a passion of jealousy amounting to insanity on her refusal to longer associate with him, may be asked on crossexamination as to whether or not her husband had forbidden him to further associate with her.' And where it is claimed that the accused committed the murder while insane, and that the insanity was caused by the discovery of improper relations between the person killed and his wife, evidence that a few months previous to their marriage he had sought to make her a public character for purposes of gain is admissible.' So, evidence in an action upon contract in which insanity is alleged as a defense that the plaintiff took a mortgage as security for certain responsibilities out of which the contract originated, and that while sane he received from the avails of the mortgage a sum more than sufficient to indemnify him for the contract, is admissible, not to ratify or confirm the contract, but as tending to prove by the recognition of it that he was of sound mind at the time.' And proof may be given in an action to recover for property sold in which the vendee introduced testimony as to the consideration paid in connection with evidence of the vendor's incapacity and the defendant's knowledge of it, that the value of the property was greater than the price given.' But evidence as to the actual value of property in such a case is competent only when offered to show that the price paid was so exorbitant as to be inconsistent with good faith upon the part of the-purchaser." And evidence in an action upon contract made with an alleged lunatic that when he signed it he was security for the other party in a large amount, and that the other party had no means of credit, is inadmissible.' Available in PDF, EPUB and Kindle. Book excerpt: Forensic psychiatry (the interface of psychiatry and the law), forensic psychology, and mental health law are growing and evolving subspecialties in their respective larger disciplines. Topics included in these fields include a range as diverse as capital sentencing guidelines, informed consent, and standards of care for mental health treatment. All of these topics need to be understood and mastered by clinicians, educators, administrators and attorneys working with psychiatric patients. This book brings together concise, comprehensive summaries of the most important "landmark" legal decisions relating to mental health practice in the United States. These decisions, along with their underlying reasonings, make up a critical portion of the national certification examination for forensic psychiatry offered by the American Board of Psychiatry and Neurology (ABPN). Many of the themes are also tested in the ABPN certification examination for general psychiatry. This book is the first to provide a combination of summaries of the relevant legal content paired with board-style test questions designed to help consolidate knowledge and prepare for certification. Cases with similar themes are grouped together with an eye toward helping the reader understand the evolution of legal and clinical thinking on a particular topic. This book represents an important addition to the study tools and textbooks available related to psychiatry and the law and will serve as a useful reference for clinicians who must follow established legal requirements in their field.

Book excerpt: Excerpt from Medical Jurisprudence of Insanity, or Forensic Psychiatry, Vol. 2 Ethyl alcohol, Spirit of wine, is commercially assumed to be the base of intoxicating drinks, and the purest of these is capable of working great havoc when abused but on account of the demand for cheap liquor in vast quantities, what is known to chemists as the more poisonous amyl alcohol (potato spirit or fusel oil) is sub stituted for portions of the less harmful ethyl or vinic alcohol. The aroma, or bouquet, of liquors is largely due to certain others of the more poisonous amyl and butyl alcohols, notably the acetic and valeric. All too often, by the time it reaches the average consumer, liquor contains, in addition to the alcohol, diluents to increase bulk, and articles to give it false color, odor, and taste. In the English licensing act of 187 2' there is a schedule of substances called deleterious ingredients, found to have been used in adulterating intoxicating liquors. They are cocculus Indicus, common salt, copperas, Opium, Indian hemp, strychnine, tobacco, darnel seed, logwood, salts of zinc or lead, and alum; and there are also added correctives of acidity, such as litharge, lime, soda, potash astringents like catechu, oak-bark, and sloe leaves; earths for decolorizing; sweetening agents, and ethers for fia voring. Most of these articles are unwholesome, to say the least, and tend to debilitate and otherwise create depraved bodily states. Book excerpt: Once upon a time only forensic psychiatrists had much to do with law and the legal system. Now, hardly a day passes in the life of a clinician without some significant encounter with the interface between the law and the practice of psychiatry. That interface extends all the way from the general regulation of clinical practice to the specifics of clinical man agement of individual patients. It includes, like the chapters of this book, such important topics as informed consent, right to treatment, privilege and confidentiality, patients' rights, competency, psychiatric testimony, malpractice, and liability. Dr. Halleck is one of the professions' most distinguished thinkers and authors in the field of psychiatry and law, and is this year's recipient of the coveted Isaac Ray Award of the American Psychiatric Association. Having spent his entire academic and professional life deeply involved in the clinical practice of psychiatry, he is particularly well suited to understand and respond to the clinician's need for a clear and concise elucidation of those areas of psychiatry and law which are involved in the daily work of psychiatrists and all mental health professionals.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines core issues related to legal insanity, integrating perspectives from psychiatry, law, and ethics. Various criteria for insanity are analyzed and recommendations for forensic psychiatric and legal practice are offered. Many legal systems have an insanity defense, in one form or another. Still, it remains unclear exactly when and why mental disorders affect a person’s moral or criminal responsibility. Questions addressed in this book include: Why should insanity be a component of our legal system? What should be the criteria for an insanity defense? What would be the reasons for abolishing it? Who should bear the burden of proof? Furthermore, the book discusses the impact neurosciences may have on psychiatric and psychological evaluations of defendants as well as on legal decisions about insanity.
