Maternity is defined as the personal status (filiation) of a woman who gave birth to a child. It is typically complemented by the fatherhood of the man from whom the child biologically originates (often quem nuptiae demonstrant). However, in some states, a kind of competitive way of acquiring the legal status of mother and father (or “homosexual parents A and B”) has been introduced via concluding a contract with a surrogate mother. Usually with a woman coming from poorer societies and with the assistance of professional intermediaries and organizers. The postulates to change substantive family law, or at least to recognize the effects of foreign law and procedures (a kind of “procreative tourism”), appear nowadays also in states generally prohibiting surrogate motherhood. The issues discussed in this volume concern both national law and international court cases. Recent examples include the opinion of the European Court of Human Rights of 10 April 2019 initiated by the French Cour de cassation, the judgement of the German Bundesgerichtshofof 20 March 2019, and dilemmas of Polish administrative courts. Focusing on the international perspective, the present volume as well as an accompanying book in Polish are the results of the international cooperation of over 30 experts from both member states and observer states of the Council of Europe. The monograph is structured “from the general to the detail” and includes a comprehensive view as well: from the issues of philosophy and sociology of law, to human rights standards of national constitutions and international agreements, to principles of ordre public of forum and their protection with measures of private, public, and penal law. In the past few decades, reproductive tourism has become a global industry in which individuals or couples travel, usually across borders, to gain access to reproductive services. This marketable field has expanded commercial gestational surrogacy--defined by a contractual relationship between an intending couple and gestational surrogate in which the surrogate has no genetic tie to fetus--to take on transnational complexities. India has experienced extreme growth due to a preferable combination of western educated doctors and extremely low medical costs. However, a slew of ethical issues have been brought to the forefront: the big ones manifesting as concern for reduction of a woman's worth to her reproductive capabilities along with concern for exploitation of third world women. This project will be based exclusively on literature review and serves primarily as a call for cultural competency and understanding the circumstances that gestational surrogates are faced with before implementing policy regulating commercial gestational surrogacy. The paper argues that issues of exploitation and commodification hinge on constructions of motherhood. It is critical to define and understand definitions of motherhood and how these definitions affect a woman's approach to reproduction within the cultural context of a gestational surrogate. This paper follows the case study of the Akanksha Infertility Clinic in northern India, a surrogacy clinic housing around 50 Indian surrogates. The findings of the project invokes the critical significance of narrative ethics, which help Indian surrogates construct the practice of surrogacy so that it fits into cultural comprehensions of Indian motherhood--in which motherhood is selfless, significant, and shared.

This lack of standardization can cause problems between surrogates and intended parents and can be troublesome for healthcare providers.The purpose of this study was to understand the current practices regarding discussion of potential pregnancy complications and prenatal testing in an attempt to determine how these decisions are made. This study also examined how comfortable surrogates felt expressing their opinions with the intended parents regarding these topics.Surveys were distributed through four surrogacy agencies and included several topics that could pose a potential conflict between the surrogates and intended parents. One hundred and eleven participants were included in this study. Decisional topics included carrier screening, fetal anomalies, and screening/testing options. The number of topics discussed by the surrogates varied, with about 1/3 of participants reporting that they discussed most or all of these topics before being matched with the intended parents. Decisions during the pregnancy were most often made by medical professionals, followed by the gestational surrogate and intended parent(s) together. Most participants felt comfortable voicing their opinions and that their opinions were considered throughout the surrogacy experience. These results indicate that surrogates generally feel comfortable and empowered throughout their experience.The results of this study revealed overall positive experiences for the surrogates. Having standardized guidelines may increase satisfaction with the surrogacy process and be beneficial in preventing serious conflicts between surrogates and intended parents. Given the recent increase in prenatal screening and testing options, standardized guidelines are needed to assist genetic counselors with facilitating discussions between surrogates and intended parent(s).
