Book Synopsis Fundamental Rights and Private Law in Europe by : Nuno Ferreira
Download or read book Fundamental Rights and Private Law in Europe written by Nuno Ferreira and published by Routledge. This book was released on 2011-05-19 with total page 331 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book explores, from a comparative and inter-disciplinary perspective, the relationship between fundamental rights and private law in Europe, a debate usually referred to as Drittwirkung or ‘horizontal effect of fundamental rights’. It discusses the different models of ‘horizontal effect’ and the impact that fundamental rights may have in shaping tort law, especially the position of child tortfeasors. The book concentrates on several European jurisdictions, namely France, Italy, Germany, Portugal, Sweden, Finland, and England and Wales. At a crossroad between human rights and European private law, this study draws insights from several legal fields (international, European, tort, constitutional and child law), sociology, psychology, and feminist studies. It also considers policy implications and advances proposals which would ensure the optimisation of the effect, and maximisation of the effectiveness, of fundamental rights in tort law, and more generally in private law. This book departs from traditional legal doctrines and offers a more pragmatic, comprehensive and just legal analysis of the role of fundamental rights in private law. It will be of interest to undergraduate and postgraduate students, academics, practitioners, policy-makers and activists with an interest in human rights, tort law, comparative law, children’s rights and European private law.

Book Synopsis Mediazione su ordine del giudice a Firenze by : Paola Lucarelli (a cura di)
Download or read book Mediazione su ordine del giudice a Firenze written by Paola Lucarelli (a cura di) and published by UTET Giuridica. This book was released on 2015-04-14 with total page 285 pages. Available in PDF, EPUB and Kindle.

Available in PDF, EPUB and Kindle.

Available in PDF, EPUB and Kindle. Book excerpt: La riforma Cartabia (d.lgs.
Book Synopsis Changing Attitudes to Punishment by : Julian Roberts
Download or read book Changing Attitudes to Punishment written by Julian Roberts and published by Routledge. This book was released on 2013-01-11 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: Throughout the western world public opinion has played an important role in shaping criminal justice policy. At the same time opinion polls repeatedly demonstrate that the public knows little about crime and justice, and holds negative views of the criminal justice system. This book, consisting of chapters from leading authorities in the field, is concerned to address this problem, and draws upon research in a number of different countries to address the issues arising from this state of affairs. Its main aims are: to explore the changing and evolving nature of public attitudes to sentencing to examine the factors that influence public opinion and to bring together recent international research which has demonstrated ways in which public attitudes can be changed to propose specific strategies to respond to the crisis in public confidence in criminal justice.
Book Synopsis Restorative Justice, Self-interest and Responsible Citizenship by : Lode Walgrave
Download or read book Restorative Justice, Self-interest and Responsible Citizenship written by Lode Walgrave and published by Routledge. This book was released on 2013-05-13 with total page 248 pages. Available in PDF, EPUB and Kindle. Book excerpt: Lode Walgrave has made a highly significant contribution to the worldwide development of the restorative justice movement over the last two decades. This book represents the culmination of his vision for restorative justice. Coming to the subject from a juvenile justice background he initially saw restorative justice as a means of escaping the rehabilitation-punishment dilemma, and as the basis for a more constructive judicial response to youth crime that had been the case hitherto. Over time his conception of restorative justice moved in the direction of focusing on repairing harm and suffering rather than ensuring that the youthful offender met with a 'just' response, and encompassing the notion that restorative justice was not so much about a justice system promoting restoration, more a matter of doing justice through restoration. This book develops Lode Walgrave's conception of restorative justice further, incorporating a number of key elements. • a clearly outcome-based definition of restorative justice • acceptance of the need to use judicial coercion to impose sanctions as part of the reparative process • presenting restorative justice as a fully fledged alternative to the punitive apriorism • development of a more sophisticated concept of the relationship between restorative justice and the law, and acceptance of the need for legal regulation • a consideration of the expansion of a restorative justice philosophy into other areas of social life and the threats and opportunities this provides • a consideration of the implications of the expansion of restorative justice for the discipline of criminology and democracy

Available in PDF, EPUB and Kindle. Book excerpt: XIV The stability of a philosophical construction will depend not only upon the solidity of the blocks, of the pillars and architraves that make it up, but also upon the way in which all these parts are connected. Of course, it will not be possible to argue for every single part of a philosophical building: to do so would mean to embark in a virtually endless enterprise. Accordingly, some of the parts of a philosophical building will have to be taken from the literature on the subject as 'ready made' or 'semi-finished' elements, while others will be argued for in the course of building. This is what happened in my work too. In some cases (for in stance, in the case of epistemic relativism), my concern was to illustrate theses which I believed to be sufficiently consolidated, rather than to ar gue for them. In other cases - where I was directly engaged in building the theory that I want to fonnulate - I did exactly the opposite. This is what I have tried to achieve, for example, for those proper architraves of my construction, viz. the connection between scepticism and metaphysi cal realism. and the thesis of the nonnative value of the fundamental epistemological notions (truth, objectivity, and rationality).
