Available in PDF, EPUB and Kindle. Book excerpt: The reader-friendly approach of this casebook provides a hands-on, experiential learning environment that can be essential to many students’ success. Simply knowing the facts of a benchmark case is not enough; knowing how to apply the doctrine from one case to a different set of facts enhances a student’s ability to succeed in and after law school. With the practice-based exercises in every chapter, students learn to apply legal principles and concepts to real-world scenarios. Key Features: • Case Previews and Post-Case Follow-Ups. To succeed, law students must know how to deconstruct and analyze cases. Case Previews highlight the legal concepts in a case before the student reads it. Post-Case Follow-Ups summarize the important points and ramifications but also goes one step further, noting the significance of a case to current law. • Real Life Applications. Every case in a chapter is followed by Real Life Applications, which present a scenario similar to the facts in the case followed by a series of related questions. Real Life Applications challenge students to apply what they have learned and help prepare them for real-world practice. Professors can use Real Life Applications to spark class discussions or use them as individual short-answer assignments. • Applying the Concepts and Civil Procedure in Practice. These end-of-chapter exercises encourage students to synthesize chapter material and apply relevant legal doctrine and code to real-world scenarios. Students can use these exercises for self-assessment, or the professor can use them to promote class interaction. New to the Third Edition: • Current issues regarding generative AI as it relates to Rule 11 and Discovery. • The COVID-19 Pandemic’s effects on litigation. • An explanation of the U.S. Supreme Court’s latest Personal Jurisdiction cases. • A discussion of Snap Removal. Professors and students will benefit from: • Explanatory text on the key concepts, allowing professors to spend more class time on application of the concepts rather than explanation of basic doctrine • Essay, short answer, and multiple-choice questions in every chapter, along with model answers in the teacher’s manual for each question. • Exhibits containing the relevant constitutional, statutory, or rule text. • Case Previews and Follow-ups that help to frame the key issues in the case and discussion of how the holdings have developed in subsequent cases

Book excerpt: The new edition of this thought-provoking casebook incorporates important new material into a framework that has been proven and updated through classroom use. CIVIL PROCEDURE: Theory and Practice, Second Edition, integrates traditional, thorough doctrinal coverage and the Socratic method with contextual, strategic lawyering perspectives and the opportunity to explore challenging theoretical questions. The casebook helps students recognize the relevance of procedural issues in litigation by: using the Socratic method to encourage student thought, with introductory text, examples, and hypotheticals to equip students for the challenges of practice creating a sophisticated yet clear and straightforward text that provides students with clear exposition that never hides the ball yet still requires students to work to achieve deeper insights opening with an overview of the entire civil litigation process, using the landmark N.Y. Times v. Sullivan case, real pleadings, and actual discovery materials to introduce basic elements of civil litigation showing the connection between the classroom and the courtroom with an innovative Anatomy of a Litigation case study chapter that leads students systematically through the process from pleadings to verdict and requires students to apply what they learn to a factually complex tort case centered around an airplane crash providing comprehensive coverage of the full range of topics, including in-depth treatment of personal and subject matter jurisdiction, complex joinder, preclusion, and alternative dispute resolution facilitating analysis with accessible background material for each major case utilizing extensive notes and questions to frame conceptual issues and provide the beginning of the answer so students have a starting point and are able to develop strategic and critical thinking skills selecting an excellent assortment of leading cases and high-interest cases, balancing lightly edited cases for analysis with tightly edited cases to cover more conceptual ground and strategy objectives The Second Edition introduces exciting new content and coverage: new co-author Tobias Barrington Wolff brings his valuable experience and expertise to the writing team a new chapter on remedies and provisional relief provides vital coverage of the larger litigation process additional coverage of trial procedures and juries allows instructors to emphasize the practical side of adjudication updated material on class actions and joinder (thorough, up-to-date coverage of revised Federal Rule 23, the Class Action Fairness Act of 2005, and other recent developments in complex litigation) and notice, due process, and personal jurisdiction (expanded discussion of procedural due process and its relationship to notice and jurisdiction; more concise treatment of nationwide jurisdiction and other less central issues) revised preclusion chapter responds to feedback from adopters on how best to synthesize material for students and includes a section on the doctrine of judicial estoppel recently embraced by the U.S. Supreme Court in New Hampshire v. Maine thorough, easy-to-understand treatment of Semtek and its relationship to the Erie doctrine new comparative material on attorneys fees to introduce students to the many alternatives that exist within and outside the standard American legal system fully revised Teachers Manual offers sample syllabi and helpful suggestions on course structuring

Book excerpt: This Handbook is designed to help people dealing with civil lawsuits in federal court without legal representation. Proceeding without a lawyer is called proceeding "pro se1," a Latin phrase meaning "for oneself," or sometimes "in propria persona," meaning "in his or her own person." Representing yourself in a lawsuit can be complicated, time consuming, and costly. Failing to follow court procedures can mean losing your case. For these reasons, you are urged to work with a lawyer if possible. Chapter 2 gives suggestions on finding a lawyer. Do not rely entirely on this Handbook. This Handbook provides a summary of civil lawsuit procedures, but it may not cover all procedures that may apply in your case. It also does not teach you about the laws that will control your case. Make sure you read the applicable federal and local court rules and do your own research at a law library or online to understand your case. The United States District Court for the Northern District of California has Clerk's Offices in the San Francisco, San Jose and Oakland courthouses. Clerk's Office staff can answer general questions, but they cannot give you any legal advice. For example, they cannot help you decide what to do in your lawsuit, tell you what the law means, or even advise you when documents are due. There are Legal Help Centers in the San Francisco, Oakland and San Jose courthouses where you can get free help with your lawsuit from an attorney who can help you prepare documents and give limited legal advice. This attorney will not be your lawyer and you will still be representing yourself. See Chapter 2 for more details.

Construction Laborers which appeared in the first edition, has been replaced with a shorter, and more teachable case addressing the federal courts' federal question jurisdiction. Since its publication, the first edition of the casebook has been adopted by teachers at such schools as George Washington University, Hamline, Iowa, Michigan State, University of Missouri (KC), Nova, Pittsburgh, Richmond, St. Louis, Texas Wesleyan, Tulane, Tulsa, and the University of Virginia.
