Book Synopsis The Legalist Reformation by : William E. Nelson
Download or read book The Legalist Reformation written by William E. Nelson and published by Univ of North Carolina Press. This book was released on 2003-01-14 with total page 468 pages. Available in PDF, EPUB and Kindle. Book excerpt: Based on a detailed examination of New York case law, this pathbreaking book shows how law, politics, and ideology in the state changed in tandem between 1920 and 1980. Early twentieth-century New York was the scene of intense struggle between white, Anglo-Saxon, Protestant upper and middle classes located primarily in the upstate region and the impoverished, mainly Jewish and Roman Catholic, immigrant underclass centered in New York City. Beginning in the 1920s, however, judges such as Benjamin N. Cardozo, Henry J. Friendly, Learned Hand, and Harlan Fiske Stone used law to facilitate the entry of the underclass into the economic and social mainstream and to promote tolerance among all New Yorkers. Ultimately, says William Nelson, a new legal ideology was created. By the late 1930s, New Yorkers had begun to reconceptualize social conflict not along class lines but in terms of the power of majorities and the rights of minorities. In the process, they constructed a new approach to law and politics. Though doctrinal change began to slow by the 1960s, the main ambitions of the legalist reformation--liberty, equality, human dignity, and entrepreneurial opportunity--remain the aspirations of nearly all Americans, and of much of the rest of the world, today.

Download or read book After Roe written by Mary Ziegler and published by Harvard University Press. This book was released on 2015-06-08 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: Forty years after the U.S. Supreme Court handed down its decision legalizing abortion, Roe v. Wade continues to make headlines. After Roe: The Lost History of the Abortion Debate cuts through the myths and misunderstandings to present a clear-eyed account of cultural and political responses to the landmark 1973 ruling in the decade that followed. The grassroots activists who shaped the discussion after Roe, Mary Ziegler shows, were far more fluid and diverse than the partisans dominating the debate today. In the early years after the decision, advocates on either side of the abortion battle sought common ground on issues from pregnancy discrimination to fetal research. Drawing on archives and more than 100 interviews with key participants, Ziegler’s revelations complicate the view that abortion rights proponents were insensitive to larger questions of racial and class injustice, and expose as caricature the idea that abortion opponents were inherently antifeminist. But over time, “pro-abortion” and “anti-abortion” positions hardened into “pro-choice” and “pro-life” categories in response to political pressures and compromises. This increasingly contentious back-and-forth produced the interpretation now taken for granted—that Roe was primarily a ruling on a woman’s right to choose. Peering beneath the surface of social-movement struggles in the 1970s, After Roe reveals how actors on the left and the right have today made Roe a symbol for a spectrum of fervently held political beliefs.
Download or read book Emma Goldman written by Kathy E. Ferguson and published by Rowman & Littlefield Publishers. This book was released on 2011-04-16 with total page 364 pages. Available in PDF, EPUB and Kindle. Book excerpt: Emma Goldman has often been read for her colorful life story, her lively if troubled sex life, and her wide-ranging political activism. Few have taken her seriously as a political thinker, even though in her lifetime she was a vigorous public intellectual within a global network of progressive politics. Engaging Goldman as a political thinker allows us to rethink the common dualism between theory and practice, scrutinize stereotypes of anarchism by placing Goldman within a fuller historical context, recognize the remarkable contributions of anarchism in creating public life, and open up contemporary politics to the possibilities of transformative feminism.
Book Synopsis Fate of the Oil from the Deepwater Horizon Spill by : Colin J. Branwell
Download or read book Fate of the Oil from the Deepwater Horizon Spill written by Colin J. Branwell and published by . This book was released on 2011 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The April 20th 2010 explosion of the Deepwater Horizon offshore drilling rig led to the largest oil spill in U.S. waters. Federal government officials estimated that the deepwater well ultimately released over 200 million gallons of crude oil. Although decreasing amounts of oil were observed on the ocean surface following the well's containment on July 15th 2010, oil spill response officials and researchers have found oil in other places. This new book examines the fate of the oil from the Deepwater Horizon spill. Direct observation and measurement of the fate of the vast majority of the estimated 200 million gallons of oil presents a considerable challenge.

Book Synopsis Retaking Rationality by : Richard L. Revesz
Download or read book Retaking Rationality written by Richard L. Revesz and published by Oxford University Press. This book was released on 2008-04-16 with total page 263 pages. Available in PDF, EPUB and Kindle. Book excerpt: That America's natural environment has been degraded and despoiled over the past 25 years is beyond dispute. Nor has there been any shortage of reasons why-short-sighted politicians, a society built on over-consumption, and the dramatic weakening of environmental regulations. In Retaking Rationality, Richard L. Revesz and Michael A. Livermore argue convincingly that one of the least understood-and most important-causes of our failure to protect the environment has been a misguided rejection of reason. The authors show that environmentalists, labor unions, and other progressive groups have declined to participate in the key governmental proceedings concerning the cost-benefit analysis of federal regulations. As a result of this vacuum, industry groups have captured cost-benefit analysis and used it to further their anti-regulatory ends. Beginning in 1981, the federal Office of Management and Budget and the federal courts have used cost-benefit analysis extensively to determine which environmental, health, and safety regulations are approved and which are sent back to the drawing board. The resulting imbalance in political participation has profoundly affected the nation's regulatory and legal landscape. But Revesz and Livermore contend that economic analysis of regulations is necessary and that it needn't conflict with-and can in fact support-a more compassionate approach to environmental policy. Indeed, they show that we cannot give up on rationality if we truly want to protect our natural environment. Retaking Rationality makes clear that by embracing and reforming cost-benefit analysis, and by joining reason and compassion, progressive groups can help enact strong environmental and public health regulation.
