Book excerpt: This book assesses the role of EU agencies and networks of regulators from a legal perspective, thus linking the role of law to the debates on network governance. Two case studies form the core of the research: EU energy and electronic communications regulation. The institutional design of EU energy and electronic communications regulation has evolved in the last two decades. Mechanisms to encourage cooperation between national regulatory authorities have progressively been established: from loose networks of regulators to enhanced networks of regulators, and, eventually, stronger and more formal forms of coordination through European agencies or other new institutional models. In the energy field, a true 'networked' European agency has been created: the Agency for the Cooperation of Energy Regulators (ACER). In telecoms, a two-tier institutional structure has been set up: the Body of European Regulators for Electronic Communications (BEREC) and the Office. The features of ACER and BEREC clearly show the intention to institutionalize the existing networks of regulators and confer a higher status upon them, with a strengthened and recognized position in the EU. However, the transformation of regulatory networks into European agencies and other hybrid institutional network models raises concerns of legitimacy and accountability. Book excerpt: Over the last two decades, EU legislation has established a growing number of subsidiary bodies commonly referred to as EU decentralised agencies. Recent years have witnessed the conferral of increasingly significant powers to these bodies to the point where the successful implementation of many of the EU's policies is now dependent upon the activities of EU agencies. While EU agencies have become indispensable in terms of their practical importance, the lack of a legal basis in the EU Treaties to establish and empower new bodies as well as the lack of an adequate framework in secondary law means that there exists little control over EU agencies. This results in critical issues, such as the absence of clear criteria prescribing when an agency may be empowered to act and also the failure to consider the interests of the actors normally responsible for the implementation of EU law, such as the Member States and the Commission. At IM'97 the two worlds of computer networks and telecommunications systems came to gether, each proposing a view to management that stems from their own paradigms. Each world made clear the need for end-to-end management and, therefore, each one stepped into the oth er's field. We feel that there is no winner but a mutual enrichment. The time is ripe for integra tion and it is likely that the next Conference will bear its fruit.
