From the South China Arbitration Award to the Bay of Bengal Case, this text includes important writings on Artic Shipping and Fisheries, the deep seabed, resources and maritime boundary regimes and studies the possibility of a new international agreement regulating the conservation of biological diversity in areas beyond national jurisdiction. Finally, it concludes by considering the challenges and opportunities of whaling in the Antarctic Case, ocean governance issues in Southeast Asia, and the exercise of control over foreign merchant vessels and state liability for wrong assessments. This volume offers much needed contemporary commentary from renowned scholars on rapidly evolving maritime topics.

Book excerpt: This textbook provides the reader with a foundation in policy development and analysis and describes how policy, including legal mechanisms, is applied to marine environments around the world. It offers a systematic treatment of all aspects of marine policy, including environmental protection, fisheries, transportation, energy, mining and climate change. It starts with a biophysical overview of the structure and function of the marine environment with a particular emphasis on the challenges and opportunities of managing the marine environment. An overview of the creation and function of international law is then provided with a focus on international marine law. It explores the geographic and jurisdictional dimensions of marine policy, as well the current and anticipated challenges facing marine systems, including climate change-related impacts and resource over-exploitation. The book should appeal to senior undergraduate and graduate students and form a core part of the curriculum for marine affairs, science and policy courses. It will also provide supplementary reading for students taking a course in the law of the oceans, but is not aimed at legal specialists.

Book excerpt: Marine and coastal resources provide millions of people with their livelihoods, such as fishing and tourism, and a range of critical additional ‘ecosystem services’, from biodiversity and culture to carbon storage and flood protection. Yet across the world, these resources are fast-diminishing under the weight of pollution, land clearance, coastal development, overfishing, natural disasters and climate change. This book shows how economic instruments can be used to incentivize the conservation of marine and coastal resources. It is shown that traditional approaches to halt the decline focus on regulating against destructive practices, but to little effect. A more successful strategy could be to establish schemes such as payments for ecosystem services (PES), or incorporate an element of financial incentives into existing regulatory mechanisms. Examples, both terrestrial and marine, from across the world suggest that PES can work to protect both livelihoods and environments. But to succeed, it is shown that these schemes must be underpinned by robust research, clear property rights, sound governance structures, equitable benefit sharing, and sustainable finance. Case studies are included from south and east Asia, Latin America, Africa and Australia. The book explores the prospects and challenges, and draws lessons from PES and PES-like programmes from across the globe.

Available in PDF, EPUB and Kindle. Book excerpt: The importance of marine and maritime policy can hardly be overstated in view of the fact that over 90% of world trade is sea-borne and the economic interests of developed, developing and emerging economies alike are all heavily dependent on international trade and commerce. What is perhaps not so readily appreciated by the world community at large including the captains of relevant industries such as shipping, fisheries, cargo and insurance interests, is that environmental issues and concerns are at the very heart of commercial growth and development. This is where the "marine" as distinguished from the "maritime" interests fit into the equation. Both are intimately inter-connected and co-related to the extent that policy development in the field cannot be achieved in a rational manner without the consideration of both these essential factors. This book attempts to bring together both these perspectives through the writings and contributions of several distinguished scholars in their respective fields of expertise. The editor is hopeful that the contributions of these individuals will serve to enhance knowledge and interest in marine and maritime policy development and formulation among those involved in this highly specialised area of endeavour, be they government administrators, private sector executives and managers, practitioners, researchers or scholars of related persuasions. The term "policy" in this book carries a broad connotation referring to both policy that is primarily law based as well as policy formulated on economic and sociological considerations. Marine and maritime business, as a significant commercial activity in the world's economy, is heavily regulated by law. In many areas of marine and maritime affairs, the nexus between legal policy and the policy influenced by market forces as well as their mutual interaction is highly significant, especially viewed from a historical perspective.

This book was released on 2014-01-07 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book examines how the absence of insurance in the past led to some special maritime liability law principles such as ‘general average’ (i.e., losses or expenses shared by all the parties to a maritime adventure) and the limitation of shipowners’ liability. In the absence of insurance, these principles served the function of insurance mostly for shipowners. As commercial marine insurance is now widely available, these principles have lost their justification and may in fact interfere with the most important goal of liability law i.e., deterrence from negligence. The work thus recommends their abolition. It further argues that when insurance is easily available and affordable to the both parties to a liability claim, the main goal of liability law should be deterrence as opposed to compensation. This is exactly the case with the maritime cargo liability claims where both cargo owners and shipowners are invariably insured. As a result, the sole focus of cargo liability law should be and to a great extent, is deterrence. On the other hand in the vessel-source oil pollution liability setting, pollution victims are not usually insured. Therefore oil pollution liability law has to cater both for compensation and deterrence, the two traditional goals of liability law. The final question the work addresses is whether the deterrent effect of liability law is affected by the availability of liability insurance. Contrary to the popular belief the work attempts to prove that the presence of liability insurance is not necessarily a hindrance but can be a complementary force towards the realization of deterrent goal of liability law.

Book excerpt: In the years since 1994, when the UN Convention on the Law of the Sea (UNCLOS) entered into force, the ocean law regime has been profoundly affected by an interplay of new forces in global ocean affairs. Numbered among them are innovations in technology and science, the emergence of intensified piracy and other challenges to maritime security, national, and regional programs. In Ocean Law and Policy: Twenty Years of Development under the UNCLOS Regime, experts from fourteen countries present nineteen papers that provide insightful analyses of these wide-ranging issues that form the emerging new context of UNCLOS as a keystone to a working regime system. Accessible as well as authoritative, this volume offers to general readers as well as academics, policy officials, and legal experts a set of important analyses and provocative insights, forming a major contribution to the literature of ocean studies.
