Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The U. S. Fishing Industry, Vol. 2: Present Condition and Future of Marine Fisheries The fishery laws, generally, could be improved with some reorganization, recodification, and clarification. First, Congress might consider reorganizing and recodifying most of the fishery laws under one title of the United States Code. While many of the laws are now in title 16, many others are scattered throughout other titles titles 15 and 46) of the Code. Either title 15 or title 16 would be a logical place for the fishery laws. Of course, there are laws that per tain to fisheries that also pertain to other matters and would be best left in place. Fisheries laws, when revised and recodified, should be separated from wildlife laws and from shipping laws. Fish conservation appears to be different from wildlife conservation and properly should be treated separately. Likewise, it might be helpful to separate fish - related laws from general shipping laws. In such areas as research and financial assistance to the fishing industry, consolidation of the laws would also be beneficial. Further, in recodifying the laws, the powers and the duties and responsibilities of the Secretary of Commerce could be clearly defined to reflect the transfer of functions under Reorganization Plan No. 4 of 1970. For example, 16 u.s.c. §742h, which lists a variety of Fish and Wildlife Reports to be made by the Secre tary of the Interior, has been changed by the Reorganization Plan. The statute does not reflect this change except for a note at the end of the provision that does not help define the functions transferred to the Secretary of Commerce without reference to the Reorganization Plan itself, and this does not, in all cases, completely clarify matters. A provision of law like section 742h could be divided into two separate statutes - one designating wild life reports required of the Secretary of the Interior and the other designating fish reports required of the Secretary of Com merce. Many laws could be changed in the same way. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: Fluctuations and declines in marine fish populations have caused growing concern among marine scientists, fisheries managers, commercial and recreational fishers, and the public. Sustaining Marine Fisheries explores the nature of marine ecosystems and the complex interacting factors that shape their productivity. The book documents the condition of marine fisheries today, highlighting species and geographic areas that are under particular stress. Challenges to achieving sustainability are discussed, and shortcomings of existing fisheries management and regulation are examined. The volume calls for fisheries management to adopt a broader ecosystem perspective that encompasses all relevant environmental and human influences. Sustaining Marine Fisheries offers new approaches to building workable fisheries management institutions, improving scientific data, and developing management tools. The book recommends ways to change current practices that encourage overexploitation of fish resources. It will be of special interest to marine policymakers and ecologists, fisheries regulators and managers, fisheries scientists and marine ecologists, fishers, and concerned individuals.

Available in PDF, EPUB and Kindle. Book excerpt: Territorial use rights in fisheries (TURFs) have existed for centuries. They are widely available for sedentary resources. In addition, however, they have appeared in a number of marine fisheries in traditional communities and are also being acquired, legally or extra-legally, for such techniques as floating fish aggregation devices and other forms of fixed gear. TURFs provide interesting opportunities for dealing with two major aspects of fisheries management -efficient production of net benefits and equitable distribution of benefits. Further exploration of the possible adoption of TURFs as a means for management seem desirable. This paper explores some of the definitional elements of TURFs and the distinctions between territorial rights and common property. It also exercises some of the conditions that may have an effect on the creation and maintenance of TURFs. And it discusses briefly some of the implications for equitable distribution of benefits.

Available in PDF, EPUB and Kindle. Book excerpt: Fisheries law enforcement, from investigation to judgement, continues to be an expensive and lengthy process in many jurisdictions. Many countries - particularly developing countries - experience such a significant backlog of pending trials for conventional criminal offences that dealing with fisheries offences is not a priority. This study suggests considering the use of administrative sanctions as a direct response to the problem and examines the administrative systems for dealing with fisheries offences in a diverse range of countries from different legal systems. It is intended to assist states in identifying the issues they need to take into account when considering the adoption of such a scheme. It is expected that the study will be especially valuable to developing states seeking to adopt a cost effective means of dealing with illegal, unreported and unregulated fishing, but which nonetheless wish to ensure that the basic individual rights of the accused are protected.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents a comprehensive analysis of the legal and policy frameworks for marine fisheries management and examines the efficiency of the institutions responsible for the formulation, implementation and enforcement of marine fisheries laws and policies in Bangladesh. Sustainable management of marine fisheries is a complex, multi-dimensional and multi-stakeholder process that entails sustainable use of marine living resources and conservation of marine biodiversity. Offering a critical analysis to these frameworks that play a crucial role in the conservation and management of fish stocks in areas within and beyond national jurisdiction, this book examines inadequacies and implementation gaps in the legislative, policy and institutional frameworks that contribute to the unsustainable exploitation of marine fish stocks in Bangladesh. It recommends law and policy reform for conservation and sustainable management of marine fisheries in Bangladesh and the Bay of Bengal.

It will be of great value to academics, professionals, and policy-makers alike.
