Available in PDF, EPUB and Kindle. Book excerpt: This book is the first of its kind to explore the problems inherent in the unification of maritime law. Featuring contributions from leading experts at European maritime law research centres, it considers international conventions, current maritime practice, standard forms and recently adopted or drafted national codifications of maritime law from the codification point of view. The book is divided into four parts which represent different views on the main topic. Part I gathers chapters dedicated to different aspects and methods of unification of maritime law on a global scale, as well as several specific issues of maritime law from the regulatory point of view. Part II of the book consists of those papers that centre around the issue of transport of goods. Part III is dedicated to codifications of carriage of passengers, cruise law and leisure navigation. Finally, Part IV addresses national codifications of maritime law. Codification of Maritime Law: Challenges, Possibilities and Experience seeks to provide common ground for future unification of maritime law, which makes the book useful both for private and public maritime lawyers and states’ maritime administrations worldwide.

Book excerpt: The long-awaited fourth edition of this classic collection reproduces the texts of conventions, draft conventions and resolutions on the law of armed conflicts which have been adopted since the codification movement started in the nineteenth century. Since the previous edition appeared the number of texts has increased, due to the rapid development of this branch of international law. In order to give the reader access to all conventions and similar texts adopted since the nineteenth century, older conventions that in the course of time were replaced by newer ones (such as the Geneva Conventions adopted before 1949) have also been reproduced. All texts are introduced by a short explanatory note. A list of signatures, ratifications and accessions, as well as the texts of reservations of individual states, are attached to each convention. The book is fully indexed.

Progress is now evident in the implementation of Chapter 17 of Agenda 21, as reviewed by the 1997 UNGA Special Session. These developments and the establishment of the International Seabed Authority (ISBA) and the International Tribunal for the Law of the Sea (ITLOS) make the continuation of the NILOS Documentary Yearbook, now in its 11th year, of particular significance in the years to come. The Yearbook compiles the documents related to ocean affairs and the law of the sea issued each year by organizations, organs, and bodies of the United Nations system. These include documents of the U.N. General Assembly, ECOSOC and its regional Commissions, the U.N. Secretary-General's Informal Consultations, PrepCom ISA/ITLOS, UNCED, UNEP and UNCTAD; followed by the documents of specialized agencies and other autonomous organizations of the U.N. system, including FAO, IAEA, ILO, IMO, UNESCO/IOC and WMO. The Yearbook reproduces in full documents issued in the course of the most recent year and lists other relevant documents. The NILOS Documentary Yearbook has proved of invaluable assistance in facilitating access by the community of scholars and practitioners in ocean affairs and the law of the sea to essential documentation.

Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides a systematic approach to transport law as applied in Spain. The book describes the main sources of transport law, jurisdiction and courts, state immunity, and the legal role of transport intermediaries, with detailed reference to maritime law, transport by road, transport by air, transport by rail, and inland navigation. A special chapter is devoted to multimodal transport. Among the elements of transport law considered are the legal status of the vessel; its acquisition, ownership, and registration; vessel liens and mortgages; the position of master and crew; maritime salvage and assistance; marine pollution; collision; and carriage of passengers. Other topics discussed include liability and limitation of liability, charter parties, and transport under bill of lading. Case law, intergovernmental cooperation agreements, and interactions with environmental, tax, and competition law are also covered. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for lawyers handling transport contracts or cases affecting Spain. It will also be welcomed by researchers and academics for its contribution to a field that continues to gain significance in the study of comparative law.

This book was released on 2010-12-16 with total page 550 pages. Available in PDF, EPUB and Kindle. Book excerpt: Limitation of liability for maritime claims is a concept of respectable antiquity which is now deeply entrenched in the maritime industry. Under this concept, the shipowner is entitled to limit his liability for maritime claims up to a maximum sum regardless of the actual amount of the claims. The concept of limitation of liability has been adopted by many conventions ranging from those relating to the carriage of goods by sea, carriage of passengers and their luggage by sea, liability and compensation for pollution damage, to liability for the removal of wrecks. Each of these conventions has its own approach to limitation of liability. However, these particular liability regimes share the international arena with global limitation conventions such as the 1976 Convention on Limitation of Liability for Maritime Claims and the 1996 Protocol thereto. This book approaches limitation of liability from an international perspective looking at a number of key conventions including the global limitation conventions, the conventions relating to the carriage of passengers and their luggage by sea (1974 Athens Convention relating to the Carriage of Passengers and Their Luggage by Sea and the 2002 Protocol thereto), conventions relating to liability and compensation for pollution damage (1969 International Convention on Civil Liability for Oil Pollution Damage and the 1992 Protocol thereto, the 1996 International Convention on Liability and Compensation for Damage in Connection with the Carriage of Hazardous and Noxious Substances by Sea and the 2010 Protocol thereto, and the 2001 International Convention on Civil Liability for Bunker Oil Pollution Damage), as well as the 2007 Nairobi International Convention on the Removal of Wrecks. Each chapter of this book sets out to analyze provisions in the conventions which have proved to be controversial and subject to debate by courts and authors, as well as the relationship between the limitation provisions in claim specific liability conventions and in the global limitation conventions. Particular attention is also given to the persons entitled to limit liability, ships in respect of which liability can be limited, claims subject to limitation, claims excepted from limitation, basis of liability (where applicable), loss of the right to limit, and the limits of liability. Limitation of Liability in International Maritime Conventions is of interest to academics and practicing lawyers who wish to understand the intricacies of the law of limitation.
