Available in PDF, EPUB and Kindle. Book excerpt: The 18 papers in this volume, originally published in 1969 in English and French, with summaries in the other language, define and analyze in their wider social contexts the fundamental ideas and procedures to be found in African traditional systems of law. They assess the needs and problems of adaptation to changing conditions. The comprehensive introduction by Allott, Epsteina nd Gluckman provides a framework of analysis. It deals with the search for a common terminology in which to analyse and compare the different systems of customary law proceedings and evidence, codification and recording, reason and the occult, the conception of legal personality, succcession and inheritance, land rights, marriage and affiliation, injuries, liability and responsibility.

Available in PDF, EPUB and Kindle. Book excerpt: Christianity and Public Culture in Africa takes readers beyond familiar images of religious politicians and populations steeped in spirituality. It shows how critical reason and Christian convictions have combined in surprising ways as African Christians confront issues such as national constitutions, gender relations, and the continuing struggle with HIV/AIDS. The wide-ranging essays included here explore rural Africa and the continent’s major cities, colonial and missionary legacies, and mass media images in the twenty-first century. They also reveal the diversity of Pentecostalism in Africa and highlight the region’s remarkable denominational diversity. Scholars and students alike will find these essays timely and impressive. The contributors demonstrate how the public significance of Christianity varies across time and place. They explore rural Africa and the continent’s major cities, and colonial and missionary situations, as well as mass-mediated ideas and images in the twenty-first century. They also reveal the plurality of Pentecostalism in Africa and keep in view the continent’s continuing denominational diversity. Studentsand scholars will find these topical studies to be impressive in scope. Contributors: Barbara M. Cooper, Harri Englund, Marja Hinfelaar, Nicholas Kamau-Goro, Birgit Meyer, Michael Perry Kweku Okyerefo, Damaris Parsitau, Ruth Prince, James A. Pritchett, Ilana van Wyk

Book excerpt: This study examines the theological and anthropological foundations of the understanding of the dignity and vocation of woman as a mother and wife, gifts given by God that expresses the riches of the African concept of family. There are two approaches to inculturation theology in Africa, namely, that which attempts to construct African theology by starting from the biblical ecclesial teachings and find from them what features of African culture are relevant to the Christian theological and anthropological values, and the other one which takes the African cultural background as the point of departure. According to John Paul II, the dignity and vocation of woman is “something more universal, based on the very fact of her being a woman within all the interpersonal relationships, which, in the most varied ways, shape society and structure the interaction between all persons,” (Mulieris Dignitatem no. 29). This “concerns each and every woman, independent of the cultural context in which she lives and independently of her spiritual, psychological and physical characteristics, as for example, age, education, health, work, and whether she is married or single,” (Mulieris Dignitatem, no. 29). The theology of inculturation as presented in this dissertation opens the way for the integration of the theological anthropological teachings of John Paul II in understanding African woman as mother and wife.

Book excerpt: This book takes a comparative law perspective and proposes a new approach for researching law in Africa. Western theoretical perspectives in comparative law are too Eurocentric to fully catch the peculiarities and characteristics of the African “lawscape”—in short, they are inadequate for studying African law. In this book, Professor Salvatore Mancuso considers the law in Africa from a different perspective. Deeply rooted in the culture of the African people, this approach considers African legal culture with the same legitimacy as Western legal culture, setting a precedent for future policy-making decisions relating to legislative development in Africa.

Available in PDF, EPUB and Kindle. Book excerpt: This groundbreaking book addresses issues of the keenest interest to anthropologists, specialists on Africa, and those concerned with international aid and development. Drawing on extensive research among the Luo people in western Kenya and abroad over many years, Parker Shipton provides an insightful general ethnography. In particular, he focuses closely on nonmonetary forms of exchange and entrustment, moving beyond anthropology's traditional understanding of gifts, loans, and reciprocity. He proposes a new view of the social and symbolic dimensions of economy over the full life course, including transfers between generations. He shows why the enduring cultural values and aspirations of East African people--and others around the world--complicate issues of credit, debt, and compensation. The book examines how the Luo assess obligations to intimates and strangers, including the dead and the not-yet-born. Borrowing, lending, and serial passing along have ritual, religious, and emotional dimensions no less than economic ones, Shipton shows, and insight into these connections demands a broad rethinking of all international aid plans and programs.

Available in PDF, EPUB and Kindle. Book excerpt: Publisher's description: In a trial in California, Navajo defendants argue that using the hallucinogen peyote to achieve spiritual exaltation is protected by the Constitution's free exercise of religion clause, trumping the states' right to regulate them. An Ibo man from Nigeria sues Pan American World Airways for transporting his mother's corpse in a cloth sack. Her arrival for the funeral face down in a burlap bag signifies death by suicide according to the customs of her Ibo kin, and brings great shame to the son. In Los Angeles, two Cambodian men are prosecuted for attempting to eat a four month-old puppy. The immigrants' lawyers argue that the men were following their own "national customs" and do not realize their conduct is offensive to "American sensibilities." What is the just decision in each case? When cultural practices come into conflict with the law is it legitimate to take culture into account? Is there room in modern legal systems for a cultural defense? In this remarkable book, Alison Dundes Renteln amasses hundreds of cases from the U.S. and around the world in which cultural issues take center stage-from the mundane to the bizarre, from drugs to death. Though cultural practices vary dramatically, Renteln demonstrates that there are discernible patterns to the cultural arguments used in the courtroom. The regularities she uncovers offer judges a starting point for creating a body of law that takes culture into account. Renteln contends that a systematic treatment of culture in law is not only possible, but ultimately more equitable. A just pluralistic society requires a legal system that can assess diverse motivations and can recognize the key role that culture plays in influencing human behavior. The inclusion of evidence of cultural background is necessary for the fair hearing of a case.
