The first chapter analyzes the background against which international jurisdiction and conflict of laws rules are drawn up and examines uniform law in this context, in particular the 2006 Maritime Labour Convention and the 2007 ILO Convention No. 188 on Work in Fishing. The second chapter addresses international jurisdiction issues as regards individual employment contracts, while also exploring other issues (e.g. insolvency-related and social security matters) that are subsequently revisited in the third chapter while discussing conflict of laws issues related to said contracts. In turn, chapter four focuses on collective labour relations and private international law, i.e. collective agreements, strikes and other forms of collective action and information, and on the participation rights of employees in business matters.

Mas este contrato se celebra, no entre el trabajador y su empleador, sino entre el trabajador y un tercero —«crew-management company» o «crew-manager»—, que es un empresario independiente, que celebra esos contratos en el marco de una previa relación de colaboración con el Naviero. La naturaleza del contrato no debiera plantear excesivas dudas: se trata de una modalidad de la Comisión mercantil, pero con notables especialidades que justifican el presente estudio: su atipicidad, su frecuente internacionalidad, el recurso a modelos contractuales prerredactados y la fraccionabilidad de contenido. En efecto: se trata de un contrato que no encontraba —hasta ahora— reflejo en la Ley positiva, y que —por esta razón— ha debido integrarse por la propia practica, merced al empleo de los formularios «CREWMAN-A» y «CREWMAN-B», elaborados por un organismo internacional —BIMCO—, bajo influencias extrañas a nuestro sistema jurídico [el Derecho anglosajón y el Derecho nórdico]. Los formularios prevén un contenido vasto y complejo, que —sin embargo— puede limitarse y reducirse, de modo que el «crew-manager» lleve a cabo sólo algunas de las actividades indicadas. Por este motivo, y dado que no existen —que sepamos— monografías españolas que hayan abordado este tema, creemos que la presente obra revista notable interés.
