Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Carl Schmitt collects thirty original chapters on the diverse oeuvre of one of the most controversial thinkers of the twentieth century. Carl Schmitt (1888-1985) was a German theorist whose anti-liberalism continues to inspire scholars and practitioners on both the Left and the Right. Despite Schmitt's rabid anti-semitism and partisan legal practice in Nazi Germany, the appeal of his trenchant critiques of, among other things, aestheticism, representative democracy, and international law as well as of his theoretical justifications of dictatorship and rule by exception is undiminished. Uniquely located at the intersection of law, the social sciences, and the humanities, this volume brings together sophisticated yet accessible interpretations of Schmitt's sprawling thought and complicated biography. The contributors hail from diverse disciplines, including art, law, literature, philosophy, political science, and history. In addition to opening up exciting new avenues of research, The Oxford Handbook of Carl Schmitt provides the intellectual foundations for an improved understanding of the political, legal, and cultural thought of this most infamous of German theorists. A substantial introduction places the trinity of Schmitt's thought in a broad context.

Book Synopsis The Constitution of Tyranny by : Brian Loveman
Download or read book The Constitution of Tyranny written by Brian Loveman and published by . This book was released on 1993 with total page 506 pages. Available in PDF, EPUB and Kindle. Book excerpt: "This first comprehensive study of the constitutional foundations of dictatorship and political repression in Spanish America reveals the historical roles of regimes of exception in impeding democratization and buttressing military participation in the region's politics. Brian Loveman concludes that constitutional provisions for regimes of exception such as state of siege, suspensions of civil liberties and rights, and military jurisdiction over civilians have been pervasive elements of Spanish American politics since the early nineteenth century - and continue to constrain democracy at the end of the twentieth." "Founded on nineteenth-century European antecedents and reflecting constitutional developments in both the Old World and the New, such provisions were repeatedly invoked to impose constitutional dictatorships from Independence to the present day. Whether in the fragmented, caudillo-dominated Rio de la Plata, or in more stable and conservative Chile, or in theocratic Ecuador under Garcia Moreno, or in "liberal" Mexico after 1857, Spanish American political leaders resorted to constitutional political repression to protect the "internal security of the state."" "Loveman systematically analyzes constitutional change in sixteen countries in Central America, South America, and the Caribbean to demonstrate how the military dictatorships and human rights violations of recent decades are linked to political developments in nineteenth-century Europe and the New World. His provocative thesis, based on extensive original research, highlights the enduring tension between liberty and order in Spanish America, the emergence of the armed forces as a major political force, and the legal bases for press censorship, political oppression, and state terrorism." "In the name of popular sovereignty and defense of order, governments sought to legitimize barbaric repression of adversaries, to justify slavery, slaughter, and mayhem. Constitutions were also useful in sanctifying intolerance. Formal acceptance of democracy belied refusal by incumbent governments to tolerate political opposition and effective exercise of civil rights and liberties." "Loveman concludes by predicting that the regime transitions that periodically sweep Spanish America will continue unless there is drastic change in the constitutional foundations of Latin American politics. His subject is so timely that no student of Latin American history and politics can afford to miss this important book. It will permanently change how we think about the other nations of the Western Hemisphere."--BOOK JACKET.Title Summary field provided by Blackwell North America, Inc. All Rights Reserved

Meaning me . They think it irregular. They go shuddering around, brooding over the reduction of that Congo population from 25,000,000 to 15,000,000 in the twenty years of my administration; then they burst out and call me the King with Ten Million Murders on his Soul. They call me a 'record'. - From King Leopold's Soliloquy
Book Synopsis The Origins of Genocide by : Dominik J. Schaller
Download or read book The Origins of Genocide written by Dominik J. Schaller and published by Routledge. This book was released on 2013-09-13 with total page 129 pages. Available in PDF, EPUB and Kindle. Book excerpt: This year the United Nations celebrated the 'Convention on the Prevention and Punishment of the Crime of Genocide', adopted in December 1948. It is time to recognize the man behind this landmark in international law. At the beginning were a few words: "New conceptions require new terms. By ‘genocide’ we mean the destruction of a nation or of an ethnic group". Rarely in history have paradigmatic changes in scholarship been brought about with such few words. Putting the quintessential crime of modernity in only one sentence, Raphael Lemkin (1900-1959), the Polish Jewish specialist in international law, not only summarized the horrors of the National Socialist Crimes, which were still underway, when he coined the term "genocide" in 1944, but also influenced international law. As the founding figure of the UN Genocide Convention Lemkin is finally getting the respect he deserves. Less known is his contribution to historical scholarship on genocide. Until his death, Lemkin was working on a broad study on genocides in the history of humankind. Unfortunately, he did not manage to publish it. The contributions in this book offer for the first time a critical assessment not only of his influence on international law but also on historical analysis of mass murders, showing the close connection between both. This book was published as a special issue of the Journal of Genocide Research.
