Available in PDF, EPUB and Kindle. Book excerpt: This book examines lawyers' contributions to creating and maintaining the rule of law, one of the pillars of a liberal democracy. It moves from the European Enlightenment to the modern day, exploring the role of judges, government lawyers, and private practitioners in creating, defining, and being defined by, the demands of modern society. The book is divided into 4 parts representing the big themes. The first part considers lawyers' contribution to the growth of constitutionalism, the second, the formulation of roles and identities, and the third the formation of values. The fourth part focuses on the challenges faced by lawyers and the rule of law in the past 50 years, the neoliberal period, and how they challenge both conceptions of lawyers and the rule of law. Each part is illustrated by defining events, from the execution of Charles I, through the Nuremberg Trials, to the insurrection by supporters of Donald Trump in January 2021. Although the focus is on England and Wales, parallel developments in other jurisdictions, Australia, Canada, New Zealand, and the USA, are considered. This allows analysis of lawyers' historical and contemporary engagement with the rule of law in jurisdictional systems based on the Common Law. Each chapter is thematic, but the passage through the book is broadly chronological.

Book excerpt: With faultless accuracy, this text is the most detailed and analytical account of law for those new to the subject. It provides commanding analysis of the English legal system, contract law, the law of torts, company law, and employment law, as well as covering relevant aspects of the law of agency and environmental law. Online chapters provide further discussion relating to the economic torts, corporate governance, the sale of goods, consumer credit, and the law relating to unfair and illegal commercial practices. All of this is discussed using relevant examples from the business environment, and the key legal cases to help develop a greater understanding of the interconnections between the law and corporate setting. The new learning features have been incorporated throughout, making this difficult subject more accessible. Key case, examples, and discussion boxes demonstrate the application of law and highlight core principles, while self-test questions allow students to assess their progress. Online Resource Centre The accompanying Online Resource Centre provides a wealth of resources for students to further develop their understanding and test their knowledge, including additional practice questions with answers, a flashcard glossary of key legal terms and updates to the law via Twitter. This new edition also includes a testbank of MCQs for lecturer use.

Available in PDF, EPUB and Kindle. Book excerpt: The development of the law of obligations across the common law world has been, and continues to be, a story of unity and divergence. Its common origins continue to exert a powerful stabilising influence, carried forward by a methodology that places heavy weight on the historical foundations of legal principles. Divergence is, however, produced by numerous factors, including national and international human rights instruments, local statutory regimes, civil law influences, regional harmonisation, local circumstances and values and different political and legal cultures. The essays in this collection explore the forces that produce divergence, the countervailing forces that generate cohesion and consistency in the common law of obligations, and the influence that the major common law jurisdictions continue to exert over one another in this area of law. The chapters in this book were originally presented at the Seventh Biennial Conference on the Law of Obligations held in Hong Kong in July 2014. A second collection, entitled Divergences in Private Law (ISBN: 9781782256601), will focus on particular departures from the common law mainstream and the causes and effects of those deviations.

The collection will be of interest to all those concerned with the role, nature and place of remedies in the private law of the common law world.

So when she has the opportunity to pretend to be Blake, she takes it. At Camp Pine Ridge, she will spread her wings and emerge a butterfly. Or at least someone who finally gets kissed by a cute guy. That is, until bad boy Ben Iron Cloud shows up, ready to get revenge on Blake—aka Mallory. If it weren’t for that infuriating girl, Ben wouldn’t even be at camp. Luckily, he now has six weeks to soak up some rays and get even with his nemesis. But the more time he spends with Blake, the more he realizes she’s nothing like the girl he thought she was—she’s kind and innocent and suddenly way too tempting. And soon enough, revenge is the last thing on his mind. Unfortunately, the girl he’s falling for is keeping a major secret... Disclaimer: This book contains a super-hot bad boy out for revenge, all sorts of camp hijinks, and a girl who realized she’s been a butterfly all along.

Book excerpt: This book frames British Romanticism as the artistic counterpart to a revolution in subjectivity occasioned by the rise of "The Rule of Law" and as a traumatic response to the challenges mounted against that ideal after the French Revolution. The bulk of this study focuses on Romantic literary replies to these events (primarily in the work of Samuel Taylor Coleridge and William Blake), but its latter stages also explore how Romantic poetry's construction of the autonomous reading subject continues to influence legal and literary critical reactions to two modern crises in the rule of law: European Fascism and the continuing instability of legal interpretive strategy.

Available in PDF, EPUB and Kindle. Book excerpt: 'Restitution for wrongs', or 'restitutionary damages', is the judicial award which compels the wrongdoer to give up to the victim the benefit obtained through the perpetration of the wrong, independently of any loss suffered by the victim. The establishment of a civil trial in Roman law, which left compensation as the main response, and a widespread, loss-centred interpretation of the Aristotelian theory of corrective justice explain, but do not justify the difficulties encountered by modern attempts to account for restitutionary damages. Mistakes in the classification of this institution have complicated the picture. To overcome some of these problems, this study considers the basic structure of restitutionary damages from different angles. In part one, the topic is analysed from a comparative perspective. Although the focus remains on English law, the German, the Italian and the Roman jurisdictions provide research data which, in part two, support the development of a theory of restitution for wrongs as corrective justice.
