Book excerpt: In 1996, the London Protocol was agreed to further modernise, and eventually replace, the 'Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter 1972', one of the first global conventions to protect the marine environment from human activities which has been in force since 1975. The Convention's objective is to promote the effective control of all sources of marine pollution and to take all practicable steps to prevent pollution of the sea by dumping of wastes and other matter. Under the Protocol all dumping is prohibited, except for possibly acceptable wastes on the so-called 'reverse list'. The Protocol entered into force on 24 March 2006. This manual provides useful, practical information to Governments, particularly those of developing countries, on the technical, economic and legal implications of ratifying, implementing and enforcing the London Protocol.

Available in PDF, EPUB and Kindle. Book excerpt: The oceans cover more than seventy per cent of the surface of the planet and they provide many vital ecosystem services. However, the health of the world's oceans has been deteriorating over the past decades and the protection of the marine environment has emerged as one of the most pressing legal and political challenges for the international community. An effective solution depends upon the cooperation of all states towards achieving agreed objectives. This book provides a critical assessment of the role that international law plays in this process, by explaining and evaluating the various legal instruments that have been negotiated in this area, as well as key trends in global ocean governance. Starting with a detailed analysis of the United Nations Convention on the Law of the Sea, the book considers the main treaties and other legal texts that seeks to prevent, reduce, and control damage to the marine environment caused by navigation, seabed exploitation, fishing, dumping, and land-based activities, as well as emerging pressures such as ocean noise and climate change. The book demonstrates how international institutions have expanded their mandates to address a broader range of marine environmental issues, beyond basic problems of pollution control to include the conservation of marine biological diversity and an ecosystems approach to regulation. It also discusses the development of diverse regulatory tools to address anthropogenic impacts on the marine environment and the extent to which states have adopted a precautionary approach in different maritime sectors. Whilst many advances have been made in these matters, this book highlights the need for greater coordination between international institutions, as well as the desirability of developing stronger enforcement mechanisms for international environmental rules.

Book excerpt: In 1989 the Contracting Parties to the Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter (the London Convention 1972) requested that the IAEA undertake the preparation of a global inventory of radioactive materials entering the marine environment from all origins. The IAEA subsequently established a global inventory which included information officially reported in or obtained from open literature and confirmed by the countries involved, on (i) the dumping at sea of radioactive waste; and (ii) marine accidents and losses involving radioactive materials. The inventory is intended as a centralized information base against which the impact of specific sources of radioactive material entering the marine environment can be assessed and compared. In 2006 the IAEA received the request to update those inventories. The present publication includes additional information provided recently by some IAEA Member States and contracting parties to the London Convention 1972 and Protocol 1996 within a process of updating the inventory which concluded in 2014, together with the information contained in previous IAEA publications. A CD ROM provides tables, maps and a database with detailed information.

Book excerpt: The African Convention on the conservation of nature and natural resources was adopted in 1968 in Algiers. Considered the most forward looking regional agreement of the time, it influenced significantly the development of environmental law in Africa. Two and a half decades of intense developments in international environmental law made it necessary to revise this treaty, update its provisions and enlarge its scope. This was undertaken under the auspices of the African Union (previously OAU), and the revision was adopted by its Heads of State and Government in July 2003 in Maputo. The introduction provides an overview of this new international treaty, as well as a commentary to each of its provisions.

Available in PDF, EPUB and Kindle. Book excerpt: It is now more than ten years since the 1982 United Nations Convention on the Law of the Sea (LOSC) came into force and more than twenty years since it was concluded in December of 1982 after more than nine years of negotiations. The famous "package deal"that it represented addressed many ofthe problematic issues that previous conventions had been unable to settle. This collection of essays, by leading academics and practitioners, provides a critical review of the LOSC and its relationship to and interface with the wide range of developments which have occurred since 1982. The individual chapters reveal a number of core themes, including the need to maintain the integrity of the LOSC and its centrality to oceans regulation; the tension between regional global regimes for oceans governance and the struggle to reconcile these within the LOSC; the gradual consolidationof authority over oceans space; the difficulty of adapting some of the more dated provisions of the LOSC to deal with unforeseen contemporary issues of oceans use; and the consequent development of the general obligations of the LOSC through binding and non-binding agreements. They clearly indicatethe potential impact and role of post-LOSC agreements and institutions in developing the law of the sea and resolving some of the outstanding substantive issues. From this it is clear that the future of the Law of the Sea will involve an understanding of the wider legal environment within which itoperates.
