Available in PDF, EPUB and Kindle. Book excerpt: La Charte. The Charter: Bill 101 and English-Speaking Quebec The Charter of the French Language, also called Bill 101, profoundly changed Quebec. The 1977 law made state institutions, certain workplaces, and commercial signs predominantly French. Since the law's adoption, the English-speaking minority has experienced population loss, economic decline, and school closures, but also a growing organizational vitality and increased participation in Francophone Quebec. This book features chapters in English or French by researchers and engaged citizens. They explore the Charter in relation to English-speaking Quebec and within a broad historical, political, legal, and socio-economic context. A complex view of the Quebec law and its communities emerges.

It outlines some historical background to these events but concentrates on the recent period & implications for contemporary Canadian life. Chapter 1 describes the context of language change, federalism as a product of demography & geography, the historical origins of the English- & French-speaking populations, the current distribution of official language groups across the country, & the context for policy making. Chapter 2 outlines the objectives pursued by the federal & provincial governments for official languages in Canada & the actions of the federal government to improve the status & use of official languages in federal institutions, to support the development of minority communities & to promote English & French throughout Canadian society. Chapter 3 reviews the major shifts in provincial policies & programs for official language minorities. Chapter 4 is a balance sheet showing the results of 3 decades of sustained effort to the English & French equal status.

Book excerpt: Bhikhu Parekh As creative and reflective agents, human beings seek meaning in their lives, and develop more or less coherent views of the world or cultures in terms of which to organize their personal and collective lives. When different groups of individuals within the same society subscribe to different ways of thought, they face the crucial question of how to deal with their cultural diversity and sustain a shared common life. Premodern societies took a relatively relaxed view of diversity and generally opted for a looser union. Modernity brought with it a very different approach to the subject. This is reflected in, among other things, the institution of the modern state, especially the liberal democracy which represents one way of constituting it. Liberal democracy has exercised a decisive influence on our political and moral imagination for the past three centuries. Unlike premodern societies which took the community as their starting point and defined the individual in terms of it, it takes the individual as the ultimate and irreducible unit of, and thus conc- tually and ontologically prior to society. The latter is taken to consist of in- viduals, and refers to the totality of its members and their formal and informal relationships. Individual are the sole and equal sources of moral claims, and social and political institutions are judged in terms of their ability to safeguard and promote individual interests.

In drawing on Cameroonian policies of which he remains a key influencer, George Ngwane offers practical insights and bold solutions that should prove insightful for those tasked with determining the intricacies by which African development potential can be realised through measures that promote both the identities and the future socio-economic and development trajectories of their countries.

Available in PDF, EPUB and Kindle. Book excerpt: Is there universalism of human rights? If so, what are its scope and limits? This book is a doctrinal attempt to define universalism of human rights, as well as its scope and limits. The book presents tests of universalism on international, regional and national constitutional levels. It is maintained that universalism of human rights is both a ‘concept’ and a ‘normative reality’. The normative character of human rights is scrutinized through the study of international and regional agreements as well as national constitutions. As a consequence, limitations of normativity are identified, usually on the international level, and take the form of exceptions, reservations, and interpretations. The book is based on the General and National Reports which were originally presented at the 18th International Congress of the International Academy of Comparative Law in Washington D.C. 2010.
