La coexistence de la responsabilité extracontractuelle (ou délictuelle) et l'apparition de régimes particuliers consacrés à la sécurité des produits amènent néanmoins à s'interroger, dans les systèmes juridiques français et québécois, sur la nature contractuelle de l'obligation de sécurité et le régime dont cette obligation doit être assortie. Cette thèse cherche à déterminer dans quelle mesure les développements récents du droit français au sujet de cette obligation peuvent être transposés en droit québécois. À l'inverse, elle aborde l'apport possible du droit québécois, à la suite de la réforme du Code civil du Québec, quant à la remodélisation de l'obligation de sécurité en droit français. La thèse vise à préciser, à travers différentes problématiques soulevées par l'obligation de sécurité, le potentiel et les limites de la circulation des modèles juridiques.
