Pour cette raison, certains pays européens ont adopté de nouvelles lois et de nouvelles politiques pour attirer les ouvriers étrangers hautement ou moyennement qualifiés. Cependant, les nouvelles mesures peuvent mettre en danger certains acquis dans ce domaine et peuvent ne pas être en accord avec les normes du Conseil de l'Europe visant à garantir les droits des travailleurs migrants, tels que la Charte sociale européenne et la Convention européenne relative au statut juridique du travailleur migrant. Cette étude se concentre sur les règles concernant le statut juridique des principales catégories de travailleurs migrants admis aux fins d'un emploi dans certains Etats membres du Conseil de l'Europe. L'étude examine la question essentielle de savoir si ces règles nationales sont conçues de manière à aider les migrants à s'intégrer dans le pays d'accueil, en leur garantissant un statut de résidence stable et l'accès aux droits sociaux, ou si elles découragent ou même empêchent une telle intégration.

Filiation is a multifaceted concept in Muslim jurisdictions. Beyond its legal aspect, it encompasses the notion of inclusion and belonging, thereby holding significant social implications. Being the child of someone, carrying one’s father’s name, and inheriting from both parents form important pillars of personal identity. This volume explores filiation (nasab) and alternative forms of a full parent-child relationship in Muslim jurisdictions. Eleven country reports ranging from Morocco to Malaysia examine how maternal and paternal filiation is established – be it by operation of the law, by the parties’ exercise of autonomy, such as acknowledgement, or by scientific means, DNA testing in particular – and how lawmakers, courts, and society at large view and treat children who fall outside those legal structures, especially children born out of wedlock or under dubious circumstances. In a second step, alternative care schemes in place for the protection of parentless children are examined and their potential to recreate a legal parent-child relationship is discussed. In addition to the countr y-specific analyses included in this book, three further contributions explore the subject matter from perspectives of premodern Sunni legal doctrine, premodern Shiite legal doctrine and the private international law regimes of contemporary Arab countries. Finally, a comparative analysis of the themes explored is presented in the synopsis at the end of this volume. The book is aimed at scholars in the fields of Muslim family law and comparative family law and is of high practical relevance to legal practitioners working in the area of international child law. Book excerpt: Since the late nineteen sixties, transnational adoption has emerged as a global phenomenon. Due to a sharp decline in infants being made available for adoption locally, involuntarily childless couples in Western Europe and North America who wish to create a family, have to look to look to countries in the poor South and Eastern Europe. The purpose of this book is to locate transnational adoption within a broad context of contemporary Western life, especially values concerning family, children and meaningful relatedness, and to explore the many ambiguities and paradoxes that the practice entails. Based on empirical research from Norway, the author identifies three main themes for analysis: Firstly, by focusing on the perceived relationship between biology and sociality, she examines how notions of child, childhood and significant relatedness vary across time and space. She argues that through a process of kinning, persons are made into kin. In the case of adoption, kinning overcomes a dominant cultural emphasis placed upon biological connectedness. Secondly, it is a study of the rise of expert knowledge in the understanding of 'the best interest of the child', and how the part played by the 'psycho.technocrats' effects national and international policy and practice of transnational adoption. Thirdly, it shows how transnational adoption both depends upon and helps to foster the globalisation of Western rationality and morality. The book is an original contribution to the anthropological study of kinship and globalisation.
