Book excerpt: The accession by the European Union to the European Convention on Human Rights (ECHR) has opened up new possibilities in terms of the constitutional recognition of fundamental rights in the EU. In the field of employment law it heralds a new procedure for workers and trade unions to challenge EU law against the background of the ECHR. In theoretical terms this means that EU law now goes beyond recognition of fundamental rights as mere general principles of EU law, making the ECHR the 'gold standard' for fundamental (social) rights. This publication of the Transnational Trade Union Rights Working Group focuses on the EU and the interplay between the Strasbourg case law and the case law of the Court of Justice of the European Union (CJEU), analysing the relevance of the ECHR for the protection of workers' rights and for the effective enjoyment of civil and political rights in the employment relation. Each chapter is written by a prominent European human rights expert and analyses the case law of the European Court of Human Rights (ECtHR), and also looks at the equivalent international labour standards within the Council of Europe (in particular the (Revised) European Social Charter), the International Labour Organization (ILO) (in particular the fundamental rights conventions) and the UN Covenants (in particular the International Covenant on Economic, Social and Cultural Rights) and the interpretation of these instruments by competent organs. The authors also analyse the ways in which the CJEU has acknowledged the respective ECHR articles as 'general principles' of EU law and asks whether the Lisbon Treaty will also warrant a reassessment of the way it has treated conflicts between these 'general principles' and the so-called 'fundamental freedoms'.

Il faudra notamment promouvoir des technologies numériques inclusives, développer le capital humain d’une main-d’oeuvre jeune, globalement peu qualifiée et qui s’accroît rapidement, augmenter la productivité des entreprises et des travailleurs du secteur informel et élargir la couverture de la protection sociale pour atténuer les risques liés aux bouleversements du marché du travail. Le présent rapport, prolongement du Rapport sur le développement dans le monde 2019 de la Banque mondiale, aborde en conclusion d’importantes questions de politique publique qui viendront alimenter de futurs travaux de recherche permettant de guider les pays africains sur la voie d’une croissance plus inclusive.

Book excerpt: Ces dernières années ont vu la consécration de l'utilisation des Nouvelles Technologies de l'Information (NTI) dans les groupes de travail en entreprise. Cette consécration est venue d'un phénomène autant médiatique que technologique : L'internet et ses apparentés (Extranet, Intranet). Cela a pour conséquence le développement de nouvelles façons de travailler, de communiquer et de gérer les connaissances dans les organisations. Pourtant, utiliser ou non les NTI est pour l'entreprise un choix stratégique : un échec peut lui être fatal. C'est ce qui est arrivé à un certain nombre d'entreprises qui se sont lancées dans des projets d'utilisation de ces nouveaux systèmes d'information sans étudier au préalable les incidences potentielles sur leurs compétences. Ceci peut expliquer pourquoi 48% des chefs d'entreprises que nous avons rencontrés conservent des a priori négatifs à l'égard de l'incidence des NTI sur l'apprentissage et les compétences dans leur organisation. Cela montre l'intérêt d'étudier l'impact des NTI sur la communication et l'acquisition individuelle et collective de connaissances dans les entreprises. Dans cette recherche, nous avons recueilli des données avant et après la phase d'intégration de nouvelles technologies informatiques dans un système d'information et de gestion. Les résultats obtenus sont issus de deux méthodes de collecte et d'analyse des données. La première fondée sur une recherche-action peut être qualifiée de qualitative alors que la seconde marquée par des calculs statistiques de différences de moyennes et de variances peut être qualifiée de quantitative. Le résultat principal de ce travail est que l'intégration des NTI dans un système d'information peut faciliter l'accès aux informations et à la connaissance et accroître la performance au poste de travail mais ne favorise pas nécessairement la collaboration entre les individus

Les données statistiques ne montrent pas clairement la mesure de cet impact. La thèse présentée se propose de reconsidérer la théorie de la production, en y insérant explicitement les activités de gestion. En somme, l'entreprise a été divisée en deux catégories d'activité. Les activités de production proprement dite représentent l'ensemble des facteurs de production alloués au processus de production. Les activités auxiliaires représentent, quant à elles, l'ensemble des facteurs non alloués au processus de production. Il ressort de l'analyse une fonction de production alternative. Une hypothèse importante du modèle adopté est la complémentarité entre les deux activités. Nous obtenons plusieurs résultats. Le premier est la détermination formelle de la productivité du gestionnaire. Le second est que tout progrès technologique aura un impact différent sur la productivité selon l'activité à laquelle la nouvelle technologie s'applique. Plus une nouvelle technologie s'orientera vers les activités auxiliaires, moins l'impact sur la productivité sera important. Des études économétriques confirment nos résultats. Nous en avons mené une sur l'industrie française pour l'année 1997. Nous obtenons que l'impact de l'informatisation du salariat sur la productivité du travail dépend de la catégorie considérée. La catégorie des employés étant celle dont l'impact est le plus modéré, voire négatif.
