Book excerpt: School personnel face the continual fear of litigation as they work each day in America's schools. Educators are especially vulnerable to suits involving tort liability issues. School employees have the responsibility to maintain the safety and welfare of their students. Even under the best circumstances, unfortunately, accidents involving students take place in schools. Consequently, school employees may be held liable for damages or injuries to students if they breach their duty of care to the student. A thorough knowledge of tort liability is essential for school personnel in helping school personnel avoid legal consequences. The purpose of this study was to examine how the courts have addressed issues related to tort liability for school personnel in the physical injury or death of students while at school or a school-related activity. School personnel must possesses knowledge of laws that affect their day-to-day activities in order to protect themselves and reduce the risk of liability. The goal of this research was to provide school personnel with information concerning the trends in cases centered upon tort liability for school personnel in an effort to improve knowledge and understanding. The West Law Digest System was used to obtain data and information on the topic of tort liability for school personnel. The study encompassed 110 cases involving tort liability for school personnel between the years of 1993-2008. Each case was analyzed according to the framework of Statsky and Wernert (1995). The analysis of the cases in the study indicated seven categories of tort liability issues that school personnel face when students are physically injured or die while at school or school-related activities. School personnel prevailed in 82 of the 110 cases involved in the study. The student was successful in 9 of the cases and the court decision was split in 19 of the court cases. As a result of these court decisions, the study determined 32 guiding principles for school personnel as they work with students on a daily basis.

Available in PDF, EPUB and Kindle. Book excerpt: Law enforcement agencies and their employees are continually at risk for potential liability related to torts, civil rights violations, and employment law issues. Litigation may involve suits by the public against officers and the administration, actions by the administration against officers, or actions by officers against the administration or members of the public they serve. Knowledge of these risks and understanding how they arise are essential to law enforcement officers, administrators, and their legal counsel. Police Liability and Risk Management: Torts, Civil Rights, and Employment Law is written by an attorney and a 34-year law enforcement veteran who knows his way around the streets and the courtroom. Dr. Robert J. Girod combines decades of teaching and practical experience with legal and academic education to compile this practical source of case law and risk management principles. The book is designed to help law enforcement professionals reduce police liability and avoid the risk of litigation—or, in the event a lawsuit does arise—to manage liability and defend themselves. In our litigious society, suits involving the law enforcement community are becoming a more common occurrence and can destroy an officer’s career or cast a pall on an entire department. By understanding the laws governing these types of issues, law enforcement professionals are better able to monitor the sources of liability and implement risk management strategies to shield their policies, practices, procedures, and protocols from the danger of liability.

Book excerpt: The growing ‘constitutional school’ of public administration has roots in the Federalist Papers, constitutional law, and the writings of several contemporary leaders and contributors in the field. It is comprised of a loose grouping of scholars who subscribe to the proposition that constitutions and the constitutional characteristics of a regime are key determinants of public administrative culture, institutions, organizations, personnel practices, budgetary and decision-making processes, commitment to the rule of law and human rights, and myriad aspects of overall behavior. Participants in constitutional school research believe that the ‘big questions’ in public administration cannot be answered without reference to constitutional designs, institutions, and regime values. This edited volume brings together the most prominent names in constitutional school scholarship in an aim to make it more visible, accessible, and central to the field of public administration's pedagogy, scholarship, and intellectual development. It will be essential reading for scholars and students of public administration with an interest in constitutional / administrative law and political theory around the globe.
