Without our history of effective collective bargaining there would be no mutual understanding, no industrial peace, no constructive cooperation between social partners. Yet there is a feeling today that this history has drawn to a close; that our post-industrial world demands something different, something our tradition of collective bargaining and collective agreements cannot give us. What information and insight can we gather to verify or challenge this feeling? This was the first major question addressed by the distinguished delegates to the twenty-seventh World Congress of Labour and Social Security Law held at Montevideo, 2'5 September 2003. The aim of the conference was to discover current problems regarding the existing structures and functions of collective bargaining in industrialized countries today'problems readily identifiable in the context of economic globalization, falling union density, the increase in atypical and knowledge-based workers, and the 'tertiarization' or declining economic importance of manufacturing-based industry. This bulletin contains some of the most important papers devoted to this major theme of the conference. It presents twenty national reports, each written by a scholar well-versed in the law and practice of collective bargaining in the country covered. Two introductory reports deal with such general issues as the varying competences of representatives under different legal systems, labor union representation within the public sector, the development of collective bargaining in EC law, the levels and structures of collective bargaining practice, and the widening gap between the relevant legal norms and real situations. The national reports were drafted on the basis of a questionnaire, which appears as an annex. This allows the reader to easily compare the solutions set forth for consideration in the various countries under review. Although a rapid process of modernization occurred, the Spanish welfare state was seen, until fairly recently, as relatively underdeveloped. However, given the progressive Europeanization and expansion of Spanish social policy, questions arise as to whether the Spanish welfare system should still be considered as peripheral to West European welfare states. This volume is divided into three sections. The first section deals with broad trends in the evolution of the Spanish welfare state. To begin with, the consolidation path of social protection policies is explored. Attention is also paid to the process of Europeanization. Furthermore, the analysis explores advances in gender equality policies. In the second section, attention is turned to governance issues, such as collective bargaining, the interplay among levels of government, the welfare mix and public support for social policies. The third and final part of the book addresses five main challenges facing the Spanish welfare state in the 21st century, namely, the need to enhance flexicurity; to achieve a better work-family balance; to coordinate immigration policies with existing social protection; to tackle the persistence of high rates of relative poverty; and to face intense population ageing, both in terms of increasing needs for care and the reform of the pension system.

Book excerpt: Although proven effective in protecting pregnancy, giving birth and breastfeeding – that is, the biological differences of women related to maternity – the current European Union (EU) legislative framework on maternity leave tends to overlook the roles of both parents, especially during the post-delivery period of ‘bonding’ with the child. This framework, along with EU law on parental leave, which does not encourage an equal take-up of the leave, gives rise to serious issues of gender equality affecting both men and women. This deeply researched and urgent book proposes alternative options for future EU law on child-related leave which can be applied to both employees and self-employed workers to mitigate these limitations and side effects. Analysing the various EU Directives which, directly or indirectly, relate to maternity leave, paternity leave, adoption leave and parental leave, as well as the corresponding case law of the Court of Justice of the EU, the author uses a social risk approach and tackles the following issues: narrow focus of the legislation on the delivering mother’s incapacity to work; in practice, excessive emphasis on the protection of the delivering mother; silent assent to the unequal distribution of caring responsibilities within the family; lack of attention to women’s labour market outcomes; and the new direction followed by the recently adopted Directive on work-life balance. The research focuses on working parents (including non-delivering parents in same-sex couples or adoption) and includes a comparative analysis of the law of six countries – Belgium, Ireland, Spain, the United Kingdom, Sweden and Portugal – chosen to illustrate the variety of national schemes available and how their desirable features can be introduced into EU law. A more balanced design of child-related leave is a must in today’s society for reasons of fairness and also for economic considerations. This complete analysis of EU legislation and case law about child-related leave – including the first-ever systematic and in-depth analysis on whether maternity leave can be considered discriminatory against fathers and a review of economic literature on how child-related leave affects the situation of women in the labour market – offers forward-looking solutions for child-related leave to enhance gender equality. In the past three decades, scholars have developed an extensive literature theorizing how hegemonic social democratic parties working in tandem with a closely-allied trade union movement constructed models of welfare capitalism. Indeed, among the most robust findings of the comparative political economy literature is the claim that the more political resources controlled by the left, the more likely a country is to have a generous, universal system of social protection. The Left Divided takes as its starting point the curious fact that, despite this conventional wisdom, very little of the world actually approximates the conditions identified by mainstream scholarship for creating universal, generous welfare states. In most countries outside of northern Europe, divisions within the left-within the labor movement, among left parties, as well as between left parties and a divided union movement-are a defining feature of politics. The Left Divided, in contrast, focuses on the far more common and deeply consequential situation where intra-left divisions shape the development of social protection. Arguing that the strength and position taken by the far left is an important and overlooked determinant of social protection outcomes, the book presents a framework for distinguishing between different types of left movements, and analyzes how the distribution of resources within the left shapes party strategies for expanding social protection in theoretically unanticipated ways. To demonstrate the counterintuitive effects of having the far-left control significant political resources, Watson combines in-depth case studies of Iberia with cross-national analysis of OECD countries and qualitative comparative analyses of other divided lefts.
