En efecto, para los primeros este sistema adecua el tiempo de utilización potencial del inmueble de uso turístico con el tiempo disponible para usarlo. Para los segundos, la ventaja deriva de la distribución de los costes de construcción entre un mayor número de personas. La LDAT ha supuesto un avance importante en su configuración jurídica, así como en su tratamiento tributario, y resulta necesario un estudio que analice de forma conjunta el régimen jurídico de la multipropiedad y su tributación. Por ello, en este libro se diferencian los tributos que inciden en los distintos momentos de la vida de este régimen: constitución, adquisición o constitución de los derechos de aprovechamiento por turno, la titularidad de los derechos, así como las consecuencias fiscales de la transmisión. En definitiva, puede afirmarse que estamos ante una obra novedosa por su temática y muy interesante tanto para los profesionales del asesoramiento y el Derecho, como para los turistas y promotores, así como para las distintas Administraciones con competencias en esta materia.

Book excerpt: En la tesis se analizan los diferentes esquemas jurídicos a través de los cuales se ha planteado el fenómeno de la multipropiedad, abarcando más de los que el legislador español determina en la Ley de Aprovechamiento por turno de bienes inmuebles de uso turístico y normas tributarias. También se revisan los antecedentes legislativos y prelegislativos, entre ellos especialmente la Directivas de la Unión Europea en la materia. Analizando esta última y sus antecedentes se llega a la conclusión, especialmente en lo que se refiere a principios, que no fue adecuadamente transpuesta a la legislación española. La Ley citada reprime el mercado de la industria y consecuentemente el del turismo, lo que va en contra de permitir la libre circulación de bienes, servicios, personas y capitales en el área Europea. También se analizan la figura jurídica de naturaleza real que fue una de las formulas adoptadas por el legislador español. Se llega a la conclusión de que no responde a un genuino derecho real. Además las razones dadas por el legislador para adoptar esta figura no justifican suficientemente esa posición. Se concluye que bastaba con una legislación que se ocupara exclusivamente, de la protección a los consumidores, sin que fuera necesario determinar una concreta naturaleza jurídica y menos excluyendo otras muchas fórmulas posibles.
