Dopo aver affrontato i profili storici della questione, con particolare riferimento alla condizione giuridica del Palazzo Apostolico sotto la Legge delle Guarentigie, la ricerca ricostruisce l' iter di formazione della disposizione, con cui si volle soddisfare l' esigenza di garantire piena libertà agli organismi della Santa Sede allocati in territorio italiano a causa della voluta esiguità dello Stato vaticano. Segue, alla luce anche del diritto internazionale e della dottrina internazionalistica, l'analisi del regime giuridico degli immobili pontifici godenti della cosiddetta "extraterritorialità ", di cui si delineano i caratteri distintivi rispetto alle altre immunità (personali, funzionali, reali, tributarie) contemplate nel Trattato lateranense.Giuseppe Dalla Torre, emerito di diritto canonico ed ecclesiastico della Libera Università Maria Ss. Assunta - LUMSA di Roma. In precedenza aveva insegnato diritto ecclesiastico e diritto costituzionale nell'Università di Bologna. Ha tenuto corsi sui rapporti fra Chiesa e Stato nelle Università Pontificie del Laterano, Urbaniana e Angelicum.
