Sir: I have to inform your Excellency that I have appointed the first day of January next to commence the line between the State of Georgia and the Creek nation. The Creeks have appointed Commissioners on their part, to attend the Commissioners of the United States, to see the line ascertained and marked. I intend to be at Fort Wilkinson by the 25th of December, and to proceed from thence up the Tulapocca to its source. If you should direct any gentlemen to attend on the part of Georgia, I shall be glad to see them at the fort, and of their company in the rout I shall go up the river. I find the Indians improve a little in their efforts to maintain a friendly intercourse with their neighbours. I find no difficulty in obtaining restitution of property taken since the treaty of Colerain, and of negros who run from the State of Georgia. In the latter case, as I have no document to satisfy one that there existed any positive engagement on the part of the Indians to restore them, I have called on the nation, ex-officio, and promised a reward of twelve and a half dollars to have them restored to their owners, and there are now in my care two of them, the property of General Mc1ntosh, of Savannah, and I request you to cause the General to be informed of this, that his negros are with the public smith at Tallauhassee, in my neighbourhood, and will remain there until he gives orders respecting them. Book excerpt: Benjamin Hawkins, U.S. Agent to the Creeks, writes to Georgia Governor Peter Early (1813-1815) on April 21, 1815. Hawkins reports that "hostile" Indians (probably rebel Creeks and Seminoles) have made five attacks since the news of peace (evidently the end of the War of 1812). He says that the chiefs convened and determined to send parties out to stop the attacks. Hawkins also includes an excerpt from a report of William Hardridge. Hardridge traveled to the British garrison near John Forbe's trade store at Prospect Bluff by the mouth of the Apalachicola River and waited for the return of Colonel Edward Nicolls. While at the fort, Hardridge spoke with Captain Ross and inquired about runaway slaves. He saw runaway slaves, who were granted their freedom by the British, as well as Indians inside the garrison. Hardridge also noted that provisions were scarce and Indians in the area were subsisting largely on alligators. Ross told Hardridge that the party of Indians who recently killed and robbed a man were from Fowltown, and they acted four days before peace was declared. Ross claimed that since then, the British have ordered the Indians to stop fighting and go home, and he told Hardridge that U.S. troops within the Creek Nation must remove themselves.

Book excerpt: Volume 133 in The Civilization of the Americas Series This book traces the emergency of the Cherokee system of laws from the ancient spirit decrees to the fusion of tribal law ways with Anglo-American law. The Cherokees enacted their first written law in 1808 in Georgia. In succeeding years the leaders and tribal councils of the southeastern and Oklahoma groups wrote a constitution, established courts, and enacted laws that were in accord with the old tribal values but reflected and accommodated to the whites' legal system. Thanks to the great gift of Sequoyah-his syllabary-the Cherokees were well versed in their laws, able to read and interpret them from a very early time. The system served the people well. It endured until 1898, when the federal government abolished the tribal government. The author provides a brief review of Cherokee history and explains the circumstances surrounding the stages of development of the legal system. Excerpts from editorials in the Cherokee Phoenix and the Cherokee Advocate, letters, and tribal documents give added insight into the problems the Cherokees faced and their efforts to resolve them. Of particular interest is a series of charts explaining the complex Cherokee spirit system of crimes (or "deviations") and the punishments meted out for them. A legal historian of Osage and Cherokee heritage, Rennard Strickland is considered a pioneer in introducing Indian law into university curriculum. He has written and edited more than 35 books and is frequently cited by courts and scholars for his work as revision editor in chief of the Handbook of Federal Indian Law. Strickland has been involved in the resolution of a number of significant Indian cases. He was the founding director of the Center for the Study of American Indian Law and Policy at the University of Oklahoma. He is the first person to have served both as president of the Association of American Law Schools and as chair of the Law School Admissions Council. He is also the only person to have received both the Society of American Law Teachers (SALT) Award and the American Bar Association's Spirit of Excellence Award.
