Available in PDF, EPUB and Kindle. Book excerpt: The era of liberal interventionism is over, and the prevailing international discourse is once again about defending state borders and putting up walls. This broad re-assertion of sovereignty and non-intervention—-often considered the normative foundation of the BRICS countries, of the Non-Aligned Movement, of Bandung, of the “Westphalian” South—-raises a series of difficult questions, not least about the management of challenges shared by all. How are we to make sense of re-organisations of intervention and non-intervention in global order? Recently the dominant way of approaching these issues has been through the lens of cosmopolitan or liberal-solidarist duties, including the Responsibility to Protect. Yet it seems doubtful that this framework is still capable of posing the right questions or generating the right sorts of answers. This volume offers a new approach that provincializes the conventional debate, de-naturalises what it takes as universal or given, and lays out a series of alternatives at a time when non-intervention, quite suddenly, seems everywhere in the discourse of international society. It does so through a genealogy of the intervention concept since 1945. Intervention before Interventionism is about the ways in which statespeople have re-ordered intervention and non-intervention since the middle of the twentieth century; it is concerned primarily with non-Western contestations of Western-dominated order; it illustrates institutional change in and through decolonization; and it provides a conceptual roadmap for understanding dilemmas of intervention and non-intervention today, particularly in relation to contestation as it has re-emerged in the twenty-first century. While building upon and conversing with existing literature, the book stands out from previous approaches insofar as it is a mapping of international struggles for the re-constitution of intervention in the globalization of the society of states.

Book Synopsis Threats of Force and International Law by : Agata Kleczkowska
Download or read book Threats of Force and International Law written by Agata Kleczkowska and published by Taylor & Francis. This book was released on 2023-06-23 with total page 187 pages. Available in PDF, EPUB and Kindle. Book excerpt: Threats of force are an inherent part of communication between some States. One prominent example is the 2017–2018 crisis in relations between the United States and North Korea, marked by multiple threats issued by both sides. Yet, despite the fact that States seem to use threats of force with unlimited freedom, they are prohibited by international law. This book presents threats of force from the perspective of the practice of States. Thus, the book is based on an examination of multiple cases when States reported threats of force. It describes what threats of force are, examines the status of the prohibition of threats of force as a legal norm, presents examples and describes the mechanisms that are available for States in case threats occur, as well as their legal consequences. The book will be an invaluable resource for academics and researchers in the areas of international security law, public international law, law of armed conflict and international relations.

Book Synopsis Neutrality in Contemporary International Law by : James Upcher
Download or read book Neutrality in Contemporary International Law written by James Upcher and published by Oxford University Press. This book was released on 2020-04-30 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: The law of neutrality - the corpus of legal rules regulating the relationship between belligerents and States taking no part in hostilities - assumed its modern form in a world in which the waging of war was unconstrained. The neutral State enjoyed territorial inviolability to the extent that it adhered to the obligations attaching to its neutral status and thus the law of neutrality provided spatial parameters for the conduct of hostilities. Yet the basis on which the law of neutrality developed - the extra-legal character of war - no longer exists. Does the law of neutrality continue to survive in the modern era? If so, how has it been modified by the profound changes in the law on the use of force and the law of armed conflict? This book argues that neutrality endures as a key concept of the law of armed conflict. The interaction between belligerent and nonbelligerent States continues to require legal regulation, as demonstrated by a number of recent conflicts, including the Iraq War of 2003 and the Mavi Marmara incident of 2010. By detailing the rights and duties of neutral states and demonstrating how the rules of neutrality continue to apply in modern day conflicts, this restatement of law of neutrality will be a useful guide to legal academics working on the law of armed conflict, the law on the use of force, and the history of international law, as well as for government and military lawyers seeking comprehensive guidance in this difficult area of the law.

Download or read book The Laws of Armed Conflicts written by Dietrich Schindler and published by BRILL. This book was released on 2004-04-01 with total page 1535 pages. Available in PDF, EPUB and Kindle. Book excerpt: The long-awaited fourth edition of this classic collection reproduces the texts of conventions, draft conventions and resolutions on the law of armed conflicts which have been adopted since the codification movement started in the nineteenth century. Since the previous edition appeared the number of texts has increased, due to the rapid development of this branch of international law. In order to give the reader access to all conventions and similar texts adopted since the nineteenth century, older conventions that in the course of time were replaced by newer ones (such as the Geneva Conventions adopted before 1949) have also been reproduced. All texts are introduced by a short explanatory note. A list of signatures, ratifications and accessions, as well as the texts of reservations of individual states, are attached to each convention. The book is fully indexed.
