Book excerpt: Veteran San Francisco policeman Mullen is out to clean up the reputation of the town by re-evaluating the activity and goals of the 1851 Vigilance Committee, which has loomed so large in historical interpretations. He analyzes the incidence of crime, and describes the development of courts, police, and jails from 1846 to 1852. Describes the day-to-day negotiation and settlement process, which keeps 99% of all lawsuits from ever coming to court. The data is drawn from interviews with lawyers involved in state and federal cases, so the perspective is a lawyer's rather than a litigant's. Paper edition (unseen), $12.95. Book excerpt: Marilyn Monroe, born Norma Jeane Mortenson on June 1, 1926, is one of the best-loved movie stars and sex goddesses of all time, although she died much too young at the age of thirty-six. Marilyn overcame multiple foster homes and an early, war-time marriage to become the wife of two of America’s most famous men: first, the baseball all-star Joe DiMaggio, and then the playwright Arthur Miller. Not surprisingly, she even caught the eye of President John F. Kennedy to whom she famously sang “Happy Birthday” in 1962 in front of an overflow crowd at New York City’s Madison Square Garden. A life-time struggle with self-confidence, tumultous marriages, ill health, and drug and alcohol addictions, Marilyn’s movie career suffered in the last years before her death. The filming of her last movie, Something’s Got to Give, was never completed. She died during production. In death as in life, Marilyn Monroe fascinates. This book is a brief history of her short life. It is filled with photos of Marilyn throughout her life. Marilyn worked with some of the best directors of her day and pushed herself to excel in comedic, dramatic, and musical roles. She was only the second female movie star to create her own production company. Marilyn may have played the dumb blonde, but that was just one more role.

Available in PDF, EPUB and Kindle. Book excerpt: "She was born nearly a century ago and has been gone for well over half that time. The body of work she left behind is of limited size and, in some cases, debatable quality. The environment in which she thrived, popular entertainment in the 1950s, is a distant memory, if that. Those are indisputable facts. Why is it, then, that they seem so immaterial? How is it that the phenomenon continues unabated, that the iconography and mythology only seem to increase? Why all the interest and speculation and merchandising, and why all the documentaries and miniseries about her? Plus, to cut a little closer, all those shelves of books? With Marilyn Monroe, there is never one single answer. To start with one of the most obvious: some of it has to do with the element of tragedy, the special kind that crashes in when a life of magnetic achievement and renown is cut short with miserable suddenness. Alexander the Great, Joan of Arc, Byron and Keats, Valentino, Hank Williams, James Dean, the Kennedys, Malcolm X, Dr. King, Joplin and Hendrix and Morrison, Elvis, Princess Diana, Michael Jackson. How natural to mourn, how easy to speculate on what could have been. Monroe offers unusually ripe territory for this, with her blatant, rapid-fire explosion into the world's consciousness, the tumult and visibility of her private and professional paths, and the sharply cut-off way she died, overlaid with just enough ambiguity to cause some people to wonder about the circumstances. From there, eventually and alas, to an unseemly franchise based on conjecture about that death, with most of the ruminations drenched in paranoia and personal agendas"--

Available in PDF, EPUB and Kindle. Book excerpt: This book considers three relationships: law and economics; economics and game theory; and game theory and law. Economists teach lawyers that economic principles cut across and integrate seemingly different legal subjects such as contracts, torts, and property. Correspondingly, lawyers teach economists that legal rationality is a separate and distinct decision-making process that can be formalized by behavioral rules that are parallel to and comparable with the behavioral rules of economic rationality, that efficiency often must be constrained by legal goals such as equal protection of the laws, due process, and horizontal and distributional equity, and that the general case methodology of economics vs. the hard case methodology of law for determining the truth or falsity of economic theories and theorems sometimes conflict. Economics and Game Theory: Law and economics books focus on economic analysis of judges’ decisions in common law cases and have been mostly limited to contracts, torts, property, criminal law, and suit and settlement. There is usually no discussion of the many areas of law that require cooperative action such as is needed to provide economic infrastructure, control public “bad” type externalities, and make legislation. Game theory provides the bridge between competitive markets and the missing discussion of cooperative action in law and economics. How? Competitive markets are examples (subset) of the Prisoners’ Dilemma, which explains the conflict between individual self-interested behavior and cooperation both in economic markets and in legislative bodies and demonstrates the need for social infrastructure and regulation of pollution and global warming. Game Theory and Law: Lawsuits usually involve litigation between two parties, not the myriad participants in markets, so the assumption of self-interest constrained by markets does not carry over to legal disputes involving one-on-one bargaining in which the law gives one party superior bargaining power. Game theory models predict the effect of different legal institutions, rights, and rules on the outcome of such bargaining. Game theory also has a natural four-model framework which is used in this book to analyze the law and economics of civil obligation, which consists of torts (negligence), contracts, and unjust enrichment.

Book excerpt: This book compels the legal profession to question its current identity and to aspire to become a strategic partner for corporate executives, clients and stakeholders, transforming legal into a function that creates incremental value. It provides a uniquely broad range of forward-looking perspectives from several different key-players in the legal industry: in-house legal, law firms, LPO’s, legal tech, HR, associations and academia. This publication is a platform for leading legal professionals that offers a new perspective on the accelerating transformation in legal. Combining expert contributions with editorial insights, it argues that the new legal function will shift from a paradigm of security to one of opportunity; that future corporate lawyers will no longer primarily be negotiators, litigators and administrators, but that instead they will be coaches, arbiters and intrapreneurs; that legal knowledge and data-based services will become a commodity; and that analytics and measurement will be key drivers of the future of the profession. A must-read for all legal professionals, this book sets the course for revitalizing the profession.
