Book excerpt: L’objectif de cette recherche est la compréhension des rapports noués entre l’État, les syndicats professionnels et le travailleur individuel, a la lumière d’une étude comparée du concept de représentativité syndicale. Dans une première partie, nous supposons que le système syndical constitue un ordre juridique distinct de l’ordre étatique. Cet ordre est analyse a l’aide du concept d’autonomie collective, qui renvoie à la capacité des acteurs professionnels d’édicter leurs propres normes juridiques. L’État ne reste pas inerte devant cet espace autonome de création de droit. Il tente de l’appréhender en l’intégrant dans sa propre structure juridique. Afin de saisir ce processus d’ingérence de l’ordre étatique dans l’ordre professionnel, on prétend que l’introduction dans la loi du concept de représentativité syndicale constitue une technique de communication entre les ordres en question. Dans une deuxième partie, nous étudions l’émergence d’une catégorie d’accords collectifs d’entreprise regroupes sous le label d’accords de gestion. Ils ressentent la spécificité de disposer des droits individuels des salaries. Cette spécificité subordonne leur opposabilité a deux conditions, l’une objective, la disponibilité des droits, l’autre subjective, la légitimité des agents de négociation.

Book excerpt: Le système de droit collectif français du travail se caractérise par une absence de reconnaissance de sphère d'autonomie exclusive au profit des partenaires sociaux. La Constitution consacre une réserve de compétence législative irréductible pour déterminer les principes fondamentaux du droit du travail, du droit syndical et de la sécurité sociale, puis elle renvoie au seul pouvoir exécutif, et à lui seul, les modalités de leur application. L'autorité étatique, consciente des vertus de la négociation collective, et le juge constitutionnel, attentif à la spécificité et à la diversité des sources propres au droit du travail, ont néanmoins permis le développement de la négociation collective. Ils ont, en particulier, favorisé l'association des acteurs sociaux au processus de création et de mise en œuvre de la norme légale, ce qui a pour effet de perturber la hiérarchie des normes et la répartition traditionnelle des compétences entre les pouvoirs législatif et réglementaire. Pour autant, ce développement de la " politique contractuelle ", et plus généralement de la négociation collective, ne s'est pas traduit par un déclin de l'autorité du législateur. En droit interne, l'autonomie collective, au sens fort, n'existe pas ; elle demeure, en dépit des apparences, un pouvoir concédé et non reconnu par l'autorité étatique qui organise et promeut la négociation collective. La participation des partenaires sociaux à l'œuvre du législateur a conduit certaines organisations patronales et syndicales à revendiquer une sphère d'intervention autonome, à l'instar de celle dont ils jouissent à certains égards au niveau communautaire. Le renforcement de l'autonomie collective des partenaires sociaux est un objectif à atteindre. Il convient de redéfinir la place de la démocratie sociale par rapport à la démocratie nationale, ce qui suppose, notamment, un renforcement de la légitimité des partenaires sociaux. Un tel objectif nécessite une refonte du droit positif (droit de la représentativité, modes de ratification des accords négociés, processus d'élaboration et de mise en œuvre de la norme légale...). La présente étude ne préconise pas la reconnaissance d'un domaine constitutionnellement réservé à la négociation collective, mais elle formule des propositions de réforme tendant à un renforcement du pouvoir normatif des partenaires sociaux. Le développement inéluctable de l'autonomie collective des partenaires sociaux devra nécessairement s'inscrire dans un processus progressif et raisonné.

The present study responds by analysing the prospects of building up structures of wage formation in Europe through a reevaluation of collective bargaining and collective agreements as they exist under the law of the most industrialized Member States. The impetus for the study is the widely debated crisis of the system of concluding regional collective agreements on wages. Social partners seem to have been trapped in fruitless conflicts on how the system must be reformed. It has become obvious that no party concerned employers, trade unions, the state has the capacity to resolve the growing difficulties of collective wage formation. In an introductory essay by the distinguished editors, this important study takes the situation in Germany, the most prominent manifestation of this European crisis, as its starting point. Then, academic experts from France, the United Kingdom, the Netherlands, and Sweden describe comparable problems in their own countries, detail approaches to dealing with them, and provide a critical commentary, including judgements and suggestions in relation to the German case. Then follows a reexamination of the situation in Germany in the light of the experience of the other countries. A final chapter outlines some preliminary interpretations of European prospects. Salient issues investigated include the following: the erosion of such ideological and legal categories and concepts as `dependent work, `solidarity', `subsidiarity' and `social self-regulation' as preconditions of traditional collective bargaining structures at national level; the decreasing membership of the bargaining partners on both sides; the shrinking rate of employees covered by collective agreements; attempts to establish a national social pact; increasing competition on global markets; decentralizing management strategies, including the abandonment of collective bargaining; and, individualized employees. The authors examine the various state structures to determine if the legal and institutional developments of the different national systems of collective bargaining constitute starting points for mutual learning in order to meet the new challenges. This leads to a discussion of which practices are successful in their original environment, and how these practices might adapt to other systems in other countries.
