Book excerpt: Cette recherche porte sur la condition des ouvriers agricoles marocains sous contrat saisonnier de l'Office des Migrations Internationales. La méthodologie retenue croise entretiens semi-directifs, travail d'archive et observation participante au sein du Collectif de défense des travailleurs agricoles saisonniers. La thèse est traversée par une question centrale : en quoi la saisonnalité de l'emploi et du séjour de la main-d'œuvre étrangère OMI, parce qu'elle allie précarité statutaire et contrôle de sa mobilité, garantit sa sujétion et sépare les espaces-temps de la production et de la reproduction de sa force de travail ? La condition ouvrière OMI est appréhendée à travers trois axes principaux : le système migratoire saisonnier, saisi notamment dans sa dimension sociohistorique (origine coloniale et évolutions de l'utilitarisme migratoire en agriculture) ; les mobilisations contre le statut et les aménagements règlementaires mis en place par l'État pour brider le droit de fuite des travailleurs migrants; la santé des saisonniers étrangers, qui se construit «malgré tout » entre invisibilisation, externalisation et résistances. Cette thèse constitue en fait une réflexion sur les migrations contrôlées et les limites de ce contrôle et montre en quoi l'agriculture intensive du Sud de la France est dépendante d'une main-d'œuvre, dont la limitation du droit au séjour à un contrat de travail temporaire garantit l'ineffectivité de ses droits. Elle apporte des éléments nouveaux pour analyser l'articulation entre le fait colonial et les migrations postcoloniales. Elle régénère enfin les analyses sur la santé au travail en déplaçant le regard vers la santé du travailleur.

Cette étude se concentre sur les règles concernant le statut juridique des principales catégories de travailleurs migrants admis aux fins d'un emploi dans certains Etats membres du Conseil de l'Europe. L'étude examine la question essentielle de savoir si ces règles nationales sont conçues de manière à aider les migrants à s'intégrer dans le pays d'accueil, en leur garantissant un statut de résidence stable et l'accès aux droits sociaux, ou si elles découragent ou même empêchent une telle intégration.
