Available in PDF, EPUB and Kindle. Book excerpt: This fully revised and updated second edition of The Oxford Handbook of Comparative Law provides a wide-ranging and diverse critical survey of comparative law at the beginning of the twenty-first century. It summarizes and evaluates a discipline that is time-honoured but not easily understood in all its dimensions. In the current era of globalization, this discipline is more relevant than ever, both on the academic and on the practical level. The Handbook is divided into three main sections. Section I surveys how comparative law has developed and where it stands today in various parts of the world. This includes not only traditional model jurisdictions, such as France, Germany, and the United States, but also other regions like Eastern Europe, East Asia, and Latin America. Section II then discusses the major approaches to comparative law - its methods, goals, and its relationship with other fields, such as legal history, economics, and linguistics. Finally, section III deals with the status of comparative studies in over a dozen subject matter areas, including the major categories of private, economic, public, and criminal law. The Handbook contains forty-eight chapters written by experts from around the world. The aim of each chapter is to provide an accessible, original, and critical account of the current state of comparative law in its respective area which will help to shape the agenda in the years to come. Each chapter also includes a short bibliography referencing the definitive works in the field.

Available in PDF, EPUB and Kindle. Book excerpt: "Law in Modern Society" is a comparative study of the place of law in societies as well as a criticism of social theory. Under what conditions do different kinds of law emerge? What are the bases of the rule of law ideal that marks advanced liberal, capitalist societies? What can the study of law teach us about social hierarchy and moral vision in these societies, and, indeed, about the specificity of Western civilization? Why do we find it necessary to struggle for the rule of law and impossible to achieve it? What political possibilities are closed or opened by present-day changes in the established styles of legality and legal thought? Unger deals with these questions in a broad range of historical settings. But he also relates them to the central issues of social theory: the method of explanation, the conditions of social order, and the nature of 'modern' society. the book argues that to resolve its own internal dilemmas the science of society must once again become both metaphysical and political.

Book excerpt: Law is the most sacred fetish of our time. From radicals to conservatives, there is no militant, activist or thinker who would consider doing without it. But the history of our fascination with law is long and complex, and reaches deeper into our culture than we might think. In After Law, Laurent de Sutter takes us on a journey to uncover the sources of our fascination. He shows that at a certain moment in our history a choice was made to treat law as a decisive feature of civilization, but this choice was neither obvious nor necessary. Other political, social, religious or cultural possibilities could have been chosen instead – from ancient Egypt to Mesopotamia, from medieval Japan to China, from Islam to Judaism, other cultures have devised sophisticated tools to help people live together without having to deal with norms, rules and principles. This is a lesson worth reflecting on, especially at a time when the rule of law and the functioning of justice are increasingly showing their sinister side – and their impotence. Is there life beyond law?

Available in PDF, EPUB and Kindle. Book excerpt: British colonists in 1830s India lived in terror of the Thugs. Reputed to be brutal criminals, the Thugs supposedly strangled, beheaded, and robbed thousands of travelers in the goddess Kali's name. The British responded with equally brutal repression of the Thugs and developed a compulsive fascination with tales of their monstrous deeds. Did the Thugs really exist, or did the British invent them as an excuse to seize tighter control of India? Drawing on historical and anthropological accounts, Indian tales and sacred texts, and detailed analyses of the secret Thug language, Martine van Woerkens reveals for the first time the real story of the Thugs. Many different groups of Thugs actually did exist over the centuries, but the monsters the British made of them had much more to do with colonial imaginings of India than with the real Thugs. Tracing these imaginings down to the present, van Woerkens reveals the ongoing roles of the Thugs in fiction and film from Frankenstein to Indiana Jones and the Temple of Doom.

Book excerpt: Louis Dumont's modern classic, here presented in an enlarged, revised, and corrected second edition, simultaneously supplies that reader with the most cogent statement on the Indian caste system and its organizing principles and a provocative advance in the comparison of societies on the basis of their underlying ideologies. Dumont moves gracefully from the ethnographic data to the level of the hierarchical ideology encrusted in ancient religious texts which are revealed as the governing conception of the contemporary caste structure. On yet another plane of analysis, homo hierarchicus is contrasted with his modern Western antithesis, homo aequalis. This edition includes a lengthy new Preface in which Dumont reviews the academic discussion inspired by Homo Hierarchicus and answers his critics. A new Postface, which sketches the theoretical and comparative aspects of the concept of hierarchy, and three significant Appendixes previously omitted from the English translation complete this innovative and influential work.

Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the unique constitutional system in operation in Thailand as a continuous process of bricolage between various Western constitutional models and Buddhist doctrines of Kingship. Reflecting on the category of 'constitutional monarchy' and its relationship with notions of the rule of law, it investigates the hybridised semi-authoritarian, semi-liberal monarchy that exists in Thailand. By studying constitutional texts and political practices in light of local legal doctrine, the book shows that the monarch's affirmation of extraordinary prerogative powers strongly rests on wider doctrinal claims about constitutionalism and the rule of law. This finding challenges commonly accepted assertions about Thailand, arguing that the King's political role is not the remnant of the 'unfinished' borrowing of Western constitutionalism, general disregard for the law, or cultural preference for 'charismatic authority', as generally thought. Drawing on materials and sources not previously available in English, this important work provides a comprehensive and critical account of the Thai 'mixed constitutional monarchy' from the late 19th century to the present day.

Available in PDF, EPUB and Kindle. Book excerpt: This volume looks at the secular state in the context of contemporary Asia and investigates whether there existed before modernity antecedents to the condition of secularity, understood as the differentiation of the sphere of the religious from other spheres of social life. The chapters presented in this book examine this issue in national contexts by looking at the historical formation of lexicons that defined the "secular", the "secular state," and "secularism". This approach requires paying attention to modern vernacular languages and their precedents in written traditions with often a very long tradition. This book presents three interpretive frameworks: multiple modernities, variety of secularisms, and typologies of post-colonial secular states.

Available in PDF, EPUB and Kindle. Book excerpt: The present volume presents a part of the results of a research project launched by the European Science Foundation (ESF) in 1977. Tribute should be paid to the late Professor Aleck Chloros, Judge in the Court of the European Community, whose belief in the European ideal and enthusiasm for European cooperation and the comparative study of legal problems made him an elo quent advocate of a large-scale ESF venture into the field of com parative law. Judge Chloros had envisaged the creation of a per manent, sizable and well-equipped European institute for compa rative legal studies. The successive working parties convoked by the Executive Council of the ESF, which I had the honour of chairing from the beginning, came to the conclusion that this am bitious vision could not be realized immediately; the financial sit uation of the member organizations of the ESF also deteriorated, making a cautious approach a necessary virtue. The solution ulti mately adopted by the last of the working parties - the Ad Hoc Committee for Comparative Law -and submitted to the General Assembly of the ESF in 1979 called for the launching of four pi lot projects. In November 1980, the Assembly approved detailed plans for two of these projects. The first of these - dealing with medical responsibility - has already been presented in an impres sive volume (E. Deutsch and H. -L. Schreiber, editors, Medical Responsibility in Western Europe.
