Book excerpt: Il est communément admis que l’ordre juridique communautaire consacre l’application d’un principe de « subsidiarité sociale », selon lequel l’action autonome des partenaires sociaux est prioritaire par rapport à l’intervention des autorités publiques communautaires et nationales. Celte interprétation doit toutefois être vérifiée et explicitée en vue de démontrer que le principe de subsidiarité constitue un outil pertinent pour comprendre et ordonnancer les relations complexes s’établissant entre l’autonomie collective et l’hétéronomie dans l’ordre juridique communautaire. Malgré l’absence de consécration textuelle de la dimension sociale de ce principe, d’une part, et du concept d’autonomie collective, d’autre part, l’étude du droit communautaire et l’analyse de la pratique conventionnelle et institutionnelle conduisent à admettre l’existenœ d’un principe général de subsidiarité dont la fonction première est de protéger l’autonomie collective des partenaires sociaux d’une intervention injustifiée et excessive des autorités publiques. Ces dernières ne doivent agir qu’en cas de défaillance de l’action autonome. L’articulation des actions normatives menées par chaque acteur est déterminée par les règles du système institutionnel communautaire, lesquelles limitent à la fois l’application complète du principe au niveau communautaire et sa mise en oeuvre dans les ordres juridiques internes. Si l’exercice de l’autonomie collective est garanti, l’effectivité de ses résultats est entravée par l’absence d’un statut juridique spécifique des actes - les accords collectifs européens- - et des acteurs - les partenaires sociaux européens -dans l’ordre juridique communautaire.

La personne morale apparaît comme le terme réunificateur de tout système representative. Dans l'ordre international, ce processus est perturbé par la présence, dans les organs intergouvernementaux, de représentants d'Etat qui sont autant d'organes des Etats membres, présence prolongée par le consentement aux actes adoptés en leur sein. Quel en est donc le sujet d'imputation : l'organisation ou ses membres ? Une théorie de l'acte doit être développée au coeur de la théorie de l'organe pour démontrer que l'organisation internationale est la personnification juridique d'une collectivité d'Etats dotée d'un système représentatif, et n'est que cela. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.
