Dans un tel contexte, où se mêlent mondialisation et divergences idéologiques, quel système retenir pour garantir l’origine et la qualité d’un vin? En France, un concept original arborant une législation spécifique se distingue, l’appellation d’origine contrôlée (AOC). La Communauté européenne s’inspirant de ce système, a mené une poliique fondée sur l’origine et la qualité des produits, en instaurant des identifiants géographiques propres tels que l’appellation d’origine protégée (AOP). Or, si la tendance actuelle est à l’harmonisation et à la clarification des concepts en la matière au niveau communautaire, il n’en reste pas moins que des difficultés subsistent sur la scène internationale. Aussi, il est à noter que le recours au droit des marques peut s’avérer utile, notamment dans un esprit plus compétitif. En effet, en alliant une indication géographique à une marque, le vin sera plus apte à se développer commercialement et à trouver sa place sur le marché vitivinicole mondial. Le choix du signe, à savoir une dénomination géographique et/ou une marque, sera conditionné par son régime juridique, par la protection recherchée, mais également par l’utilisation envisagée.
