C'est pourquoi ils utilisent parfois des structures localisées dans des pays à fiscalité privilégiée (plus communément appelés " paradis fiscaux ") ou au système fiscal classique mais qui ont mis en place des régimes particulièrement incitatifs propres à certaines zones ou activités. Si l'utilisation d'entités constituées dans ces pays ou zones " fiscalement attractifs " peut parfois permettre une optimisation fiscale, il convient néanmoins de veiller à ce que les administrations des pays concernés ne soient pas en mesure de la contester ; en effet, l'on pourrait alors aboutir au résultat inverse de celui initialement poursuivi car, dans cette hypothèse, la charge fiscale supportée par le contribuable pourrait s'avérer plus lourde en définitive. L'un des buts de l'ouvrage est précisément de mettre en garde le lecteur contre un certain nombre d'idées reçues sur les fameux " paradis fiscaux " et contre les risques qu'il y aurait à rechercher des avantages fiscaux dans des opérations réalisées sans justification économique et juridique. L'ouvrage expose, dans une première partie, les dispositions prises par la France et quelques-uns de ses principaux partenaires commerciaux en Europe pour lutter contre l'évasion fiscale internationale, tant par des mesures d'ordre interne que par des mesures conventionnelles. La deuxième partie est consacrée à la présentation du régime juridique et fiscal d'un certain nombre de " paradis fiscaux " d'une part, de régimes ou de zones à fiscalité privilégiée, d'autre part. Enfin, dans une troisième partie, nous avons tenté, par des études pratiques, de sensibiliser les lecteurs aux principaux thèmes d'actualité en matière d'optimisation fiscale internationale. Malgré la relative complexité des questions abordées, nous espérons que le lecteur trouvera dans cette quatrième édition une présentation aussi claire et pratique que possible. Faire réfléchir aux nombreuses conséquences des opérations internationales des sociétés, les exposer simplement tant pour les PME que pour les groupes : tel a été notre dessein.
